Both Suyu and Sudachi began as forks of <a href=\"https:\/\/www.theverge.com\/24098640\/nintendo-emulator-yuzu-lawsuit-switch-aftermath\" target=\"_blank\" rel=\"noopener\">Yuzu, the emulator that Nintendo sued out of existence<\/a> on March 4th.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">\u201cDiscord responds to and complies with all legal and valid Digital Millennium Copyright Act requests. In this instance, there was also a court ordered injunction for the takedown of these materials, and we took action in a manner consistent with the court order,\u201d reads part of a statement from Discord director of product communications Kellyn Slone to <em>The Verge<\/em>. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The developers of<strong> <\/strong>Suyu and Sudachi only received vague messages about how they were sharing content that allegedly violates intellectual property rights, according to images shared with <em>The Verge<\/em>. Meanwhile, Discord tells us that it\u2019s following its normal process for DMCA takedown requests \u2014 but it\u2019s not at all clear there was a valid DMCA takedown request or that those communities were actually violating IP rights, and it\u2019s quite possible Discord isn\u2019t following its own policy by kicking them out. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Remember, Nintendo got Yuzu to settle rather than proving its case in court, and the settlement did not give Nintendo the rights to Yuzu\u2019s freely copyable <a href=\"https:\/\/www.gnu.org\/licenses\/gpl-3.0.en.html\" target=\"_blank\" rel=\"noopener\">GPL v3<\/a> code. Developers of Yuzu\u2019s forks also claimed they were <a href=\"http:\/\/www.theverge.com\/24098640\/nintendo-emulator-yuzu-lawsuit-switch-aftermath#:~:text=they%E2%80%99re%20treating%20Nintendo%E2%80%99s%20lawsuit%20like%20a%20guidebook%20about%20how%20not%20to%20piss%20off%20the%20company.\" target=\"_blank\" rel=\"noopener\">changing the code further, among other practices<\/a>, in an effort to avoid pissing Nintendo off. And that code wasn\u2019t hosted on Discord in any case.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">But it\u2019s possible that people were sharing Nintendo\u2019s cryptographic keys, firmware, or even entire pirated games in these servers despite those commitments. At the end of the day, most people seeking out a Nintendo Switch emulator are looking to play Nintendo games on it. But with the servers gone, it\u2019s hard to prove either way.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Even if Suyu and Sudachi were infringing, <a href=\"https:\/\/support.discord.com\/hc\/en-us\/articles\/4410339349655-Discord-s-Copyright-IP-Policy\" target=\"_blank\" rel=\"noopener\">Discord\u2019s policy<\/a> does not suggest it would permaban, much less nuke entire servers, on the first offense. Discord did not answer questions about whether these users were repeat copyright infringers, had received any previous warnings, or were forwarded any takedown requests. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Sudachi developer Jarrod Norwell tells me it came out of the blue: \u201cTheir first email was that my account has broken the TOS, with no additional information.\u201d He claims Sudachi wasn\u2019t doing anything infringing. Later, he was told it vaguely had something to do with intellectual property but says Discord still hasn\u2019t given him any details.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">DMCA takedown requests are traditionally about <em>content<\/em>, not people or groups of people, and <a href=\"https:\/\/support.discord.com\/hc\/en-us\/articles\/4410339349655-Discord-s-Copyright-IP-Policy\" target=\"_blank\" rel=\"noopener\">Discord\u2019s policy<\/a> is written to reflect that. A valid takedown request has to include a description of the content that\u2019s infringing and where to find it; a platform then takes down the content, and users can get it reinstated if they file a \u201ccounter-notice\u201d that claims it wasn\u2019t actually infringing. At that point, Discord has done its job, and Nintendo can sue the developer directly if it wants by using the counter-notice to track them down.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">But that doesn\u2019t seem to be what happened here. It looks like Discord simply de-platformed these emulators by nuking their communication channels. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">And while <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.rid.56980\/gov.uscourts.rid.56980.11.0.pdf\" target=\"_blank\" rel=\"noopener\">the court order<\/a> that Discord mentions <em>does<\/em> ban some third parties from \u201cproviding, marketing, advertising, promoting&#8230;.or otherwise trafficking in Yuzu or any source code or features of Yuzu,\u201d it\u2019s specifically talking about third parties \u201cacting in active concert and participation with Defendant.\u201d Discord would not tell me that any of the Yuzu developers were connected to the Suyu or Sudachi projects. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">At the end of the day, platforms like Discord have no obligation to host anything they don\u2019t want to host, as we discussed back <a href=\"https:\/\/www.theverge.com\/2024\/3\/21\/24108191\/gitlab-suyu-nintendo-switch-emulator-takedown\" target=\"_blank\" rel=\"noopener\">when GitLab did something similar by deplatforming Suyu\u2019s code<\/a>. And perhaps Discord did see evidence of software piracy in these Discords. That\u2019s not currently how it\u2019s justifying these channel wipes, though.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">For some Suyu developers, this may have been the last straw: an insider tells me that after infighting, one group has splintered off to do its own projects, which may or may not be related to emulation; <a href=\"https:\/\/pastebin.com\/6FYdz9Sr\" target=\"_blank\" rel=\"noopener\">here\u2019s a Pastebin<\/a> where a \u201creal Suyu developer\u201d claims the core development team has left the project because of Suyu\u2019s \u201cradioactivity\u201d and its allegedly egotistic leader. (That leader does tend to <a href=\"https:\/\/www.reddit.com\/r\/suyu\/comments\/1c10p18\/founder_speaking_current_situation_and_future\/\" target=\"_blank\" rel=\"noopener\">bark out orders<\/a>, from what insiders have shown me.)<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Sudachi\u2019s developer, meanwhile, tells me he\u2019s still working on all his projects. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Nintendo isn\u2019t just targeting Switch emulators with its latest round of takedowns but also some of the tools that aid them: it sent DMCA takedown requests to GitHub <a href=\"https:\/\/github.com\/github\/dmca\/commit\/f4c2c915c058e01d70d7671668b4c12a4b0e45b5\" target=\"_blank\" rel=\"noopener\">to remove 27 forks of the Sigpatch Updater<\/a>, as well as <a href=\"https:\/\/github.com\/github\/dmca\/commit\/ccb374868b46ad19371d9f96cccdd6c8fc689cba\" target=\"_blank\" rel=\"noopener\">Lockpick_RCM, kezplez-nx, and Incognito_RCM<\/a>, which help Switch owners and developers obtain encryption keys.<\/p>\n<\/div>\n<\/div>\n<p><br \/>\n<br \/><a href=\"https:\/\/www.theverge.com\/2024\/4\/11\/24127545\/discord-suyu-sudachi-server-shutdown-account-ban\" target=\"_blank\" rel=\"noopener\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Discord has shut down the Discord servers for the Nintendo Switch emulators Suyu and Sudachi and has completely disabled their lead developers\u2019 accounts \u2014 and the company isn\u2019t answering our questions about why it went that far.
