Everything you should know ahead of 4\/20 &#8211; The Points Guy"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>As of February 2024, <a href=\"https:\/\/www.usnews.com\/news\/best-states\/articles\/where-is-marijuana-legal-a-guide-to-marijuana-legalization\" rel=\"noopener\" target=\"_blank\">recreational weed is legal<\/a> in 24 states; there are 38 states (plus Washington, D.C., and three territories) that allow marijuana possession for medical purposes, with 14 of those states limiting it to medical use only, per the <a href=\"https:\/\/www.pewresearch.org\/short-reads\/2024\/02\/29\/most-americans-now-live-in-a-legal-marijuana-state-and-most-have-at-least-one-dispensary-in-their-county\/#:~:text=Since%20Colorado%20and%20Washington%20became,drug%20for%20medical%20use%20only.\" rel=\"noopener\" target=\"_blank\">Pew Research Center<\/a>. Additionally, <a href=\"https:\/\/ballotpedia.org\/Marijuana_laws_and_ballot_measures_in_the_United_States\" rel=\"noopener\" target=\"_blank\">three states<\/a> have marijuana legislation on the election docket this year.<\/p>\n<p>Although these states have implemented legislation for their residents and visitors, marijuana still remains a federal offense as an illegal controlled substance, punishable by one year in jail and a $1,000 fine. This makes navigating the rules confusing when traveling from a state where marijuana is legally allowed to one where it&#8217;s not.<\/p>\n<p>Here&#8217;s what you need to know about whether or not you can fly with weed, medical and otherwise.<\/p>\n<p><a id=\"can-you-fly-with-weed\" class=\"jsx-3480274316 anchor\"\/><\/p>\n<h2 class=\"jsx-3480274316\">Can you fly with weed?<\/h2>\n<p>Aligning with federal law, U.S. Customs and Border Protection still explicitly prohibits the importation of any amount of marijuana when entering the U.S. via land, such as by car.<\/p>\n<p>&#8220;As some states have decriminalized the use and possession of marijuana, it is important that members of the traveling public clearly understand that federal law still prohibits the importation of any amount of this drug,&#8221; CBP El Paso director of field operations Hector Mancha said in a <a href=\"https:\/\/www.cbp.gov\/newsroom\/local-media-release\/cbp-reminds-public-all-marijuana-imports-are-prohibited\" rel=\"noopener\" target=\"_blank\">statement<\/a>. &#8220;Do not cross the border with any amount of marijuana at all.&#8221;<\/p>\n<p>However, when traveling domestically to states where pot is permitted, the Transportation Security Administration allows products containing up to 0.3% or less of tetrahydrocannabinol, or THC.<\/p>\n<p>&#8220;Transportation Security Officers are not law enforcement, but they are obligated to contact local law enforcement if it appears as though a passenger is in possession of a criminally banned item,&#8221; a TSA spokesperson said.<\/p>\n<p>Should the TSA refer you to local police, discretion is up to local governing bodies to pursue legal action.<\/p>\n<p>Some airports, including Chicago&#8217;s O&#8217;Hare International Airport (ORD), provide travelers with <a href=\"https:\/\/chicago.suntimes.com\/cannabis\/2022\/4\/6\/23012136\/cannabis-amnesty-boxes-ohare-midway-airport-fly-weed-pot-recreationaly-tsa-transportation-security\" rel=\"noopener\" target=\"_blank\">cannabis amnesty boxes<\/a> where they can toss their weed before going through security checkpoints.<\/p>\n<div class=\"&#10;        EmailSignUp_container__qYzYT&#10;        undefined&#10;        EmailSignUp_isLoading__i_qm0&#10;      \"><picture class=\"EmailSignUp_graphic__zgpFm\"><source media=\"screen and (max-width: 767px)\" srcset=\"\/images\/EmailSignUp\/daily-mob.svg\"\/><\/picture>\n<div class=\"EmailSignUp_form__C8FWb\">\n<p>Daily Newsletter<\/p>\n<p>Reward your inbox with the TPG Daily newsletter<\/p>\n<p>Join over 700,000 readers for breaking news, in-depth guides and exclusive deals from TPG\u2019s experts<\/p>\n<\/div>\n<\/div>\n<p>Others, including Los Angeles International Airport (LAX), release any jurisdiction to arrest individuals if complying with state marijuana laws.<\/p>\n<p>&#8220;[Los Angeles Airport Police Division] officers, who are California Peace Officers, have no jurisdiction to arrest individuals if they are complying with state law,&#8221; <a href=\"https:\/\/www.flylax.com\/lax-marijuana-policy\" rel=\"noopener\" target=\"_blank\">the airport&#8217;s marijuana policy reads<\/a>. &#8220;However, airport guests should be aware that TSA screening stations are under federal jurisdiction.&#8221;<\/p>\n<p><a id=\"can-you-fly-with-medical-marijuana\" class=\"jsx-3480274316 anchor\"\/><\/p>\n<h2 class=\"jsx-3480274316\">Can you fly with medical marijuana?<\/h2>\n<p>The same rules apply to traveling with medical marijuana.<\/p>\n<p>&#8220;Marijuana and certain cannabis-infused products, including some Cannabidiol (CBD) oil, remain illegal under federal law,&#8221; <a href=\"https:\/\/www.tsa.gov\/travel\/security-screening\/whatcanibring\/items\/medical-marijuana\" rel=\"noopener\" target=\"_blank\">as noted by the TSA<\/a>. For example, <a href=\"https:\/\/www.cdc.gov\/marijuana\/featured-topics\/CBD.html#:~:text=In%202018%2C%20the%20U.S.%20Congress,if%20it%20comes%20from%20hemp.\" rel=\"noopener\" target=\"_blank\">CBD oil derived from hemp has been legal since 2018<\/a>, but TSA rules still ban CBD oil.<\/p>\n<p>You can travel with vape pens in carry on-bags, but they cannot be checked if containing lithium batteries exceeding 100 watt hours, <a href=\"https:\/\/www.tsa.gov\/travel\/security-screening\/whatcanibring\/all?combine=batteries&amp;page=1#:~:text=Lithium%20batteries%20with%20100%20watt%20hours%20or%20less%20in%20a%20device&amp;text=Spare%20(uninstalled)%20lithium%20ion%20and,grams%20of%20lithium%20per%20battery.\" rel=\"noopener\" target=\"_blank\">according to TSA rules<\/a>. If the cartridges you&#8217;re carrying for the vape pen contain THC, those are illegal on the federal level. You can also bring marijuana paraphernalia (bowls or pipes) in your carry-on.<\/p>\n<p>Bear in mind that TSA officials are not trained specifically to differentiate between various types of cannabis products.
