{"id":80445,"date":"2024-03-04T23:22:59","date_gmt":"2024-03-04T23:22:59","guid":{"rendered":"https:\/\/entertainment.runfyers.com\/index.php\/2024\/03\/04\/the-supreme-court-cant-stop-doing-solids-for-donald-trump\/"},"modified":"2024-03-04T23:22:59","modified_gmt":"2024-03-04T23:22:59","slug":"the-supreme-court-cant-stop-doing-solids-for-donald-trump","status":"publish","type":"post","link":"https:\/\/entertainment.runfyers.com\/index.php\/2024\/03\/04\/the-supreme-court-cant-stop-doing-solids-for-donald-trump\/","title":{"rendered":"The Supreme Court Can\u2019t Stop Doing Solids for Donald Trump"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p class=\"has-dropcap\">When he\u2019s not <a href=\"https:\/\/www.vanityfair.com\/news\/donald-trump-taylor-swift-joe-biden-endorsement\" target=\"_blank\" rel=\"noopener\">feuding with <strong>Taylor Swift<\/strong><\/a> or <a href=\"https:\/\/nymag.com\/intelligencer\/2024\/02\/trump-look-like-elvis.html\" target=\"_blank\" rel=\"noopener\">claiming to look like Elvis Presley<\/a>, <strong>Donald Trump<\/strong> spends most of his days raging about how various government officials\u2014often prosecutors but sometimes also <a href=\"https:\/\/www.vanityfair.com\/news\/2020\/06\/trump-finally-figures-out-what-crime-obama-committed\" target=\"_blank\" rel=\"noopener\">former presidents<\/a> and <a href=\"https:\/\/thehill.com\/homenews\/campaign\/4157115-trump-attacks-lethargic-bill-barr-who-said-hed-be-willing-to-testify-in-jan-6-trial\/\" target=\"_blank\" rel=\"noopener\">his own Cabinet members<\/a>\u2014have wronged him. But on Monday, he was full of praise for nine DC regulars, i.e. the Supreme Court, for ruling that states can\u2019t remove him from the ballot despite the coup that he attempted just over three years ago.<\/p>\n<p>Speaking from Mar-a-Lago after the decision came down, Trump <a href=\"https:\/\/www.politico.com\/news\/2024\/03\/04\/trump-supreme-court-14th-amendment-00144681\" target=\"_blank\" rel=\"noopener\">commended<\/a> the justices for working \u201clong,\u201d \u201chard,\u201d\u00a0and \u201cvery quickly on something that will be spoken about 100 years from now and 200 years from now, [something] extremely important.\u201d Later, referring to the unanimous decision, he said he was \u201cvery honored by a nine-to-nothing vote.\u201d Not only did the Court allow Trump to remain on the ballot in Colorado, which had <a href=\"https:\/\/www.vanityfair.com\/news\/colorado-supreme-court-disqualifies-donald-trump-from-ballot\" target=\"_blank\" rel=\"noopener\">disqualified him<\/a>, but five members of the majority ensured it will be very difficult to prevent other would-be insurrectionists from running for president in the future.<\/p>\n<p class=\"paywall\">Per <a href=\"https:\/\/www.washingtonpost.com\/politics\/2024\/03\/04\/supreme-court-trump-ballot-decision\/\" target=\"_blank\" rel=\"noopener\"><em>The Washington Post<\/em><\/a><em>:<\/em><\/p>\n<blockquote class=\"BlockquoteEmbedWrapper-sc-SdiGL kMAUQf paywall blockquote-embed\">\n<div class=\"BlockquoteEmbedContent-esRbGs fyBRiV blockquote-embed__content\">\n<p>The justices drew a clear distinction between state and national elections, writing that \u201cStates may disqualify persons holding or attempting to hold state office. But States have no power under the Constitution to enforce Section 3 [of the 14th Amendment] with respect to federal offices, especially the Presidency.\u201d Five of the six conservative justices went further, writing that the disqualification clause can only be enforced for national office through federal legislation\u2014not a federal court challenge or non-legislative action by Congress.<\/p>\n<p>The three liberal justices, in their sharply worded concurrence, said the majority\u2019s\u00a0approach \u201cshuts the door on other potential means of federal enforcement. We cannot join an opinion that decides momentous and difficult issues unnecessarily.\u201d The majority, they said, had foreclosed enforcement through the courts if, for instance, \u201ca party is prosecuted by an insurrectionist and raises a defense on that score.\u201d<\/p>\n<\/div>\n<\/blockquote>\n<p class=\"paywall\">In their concurring opinion, justices <strong>Sonia Sotomayor, Elena Kagan,<\/strong> and <strong>Ketanji Brown Jackson<\/strong> criticized the majority for \u201cattempt[ing] to insulate all alleged insurrectionists from future challenges to their holding office.\u201d Even conservative justice <strong>Amy Coney Barrett<\/strong> agreed, but didn\u2019t join the liberals\u2019 opinion because she <a href=\"https:\/\/www.nytimes.com\/2024\/03\/04\/us\/politics\/supreme-court-trump-colorado-ballot-decision.html\" target=\"_blank\" rel=\"noopener\">didn\u2019t like their tone<\/a>. (She separately commented that the suit the Court was being asked to weigh in on \u201cdid not require us to address the complicated question of whether federal legislation is the exclusive vehicle through which Section 3 can be enforced.\u201d)<\/p>\n<p class=\"paywall\">Monday\u2019s ruling was, of course, not the only one the Supreme Court is expected to make this term that concerns Trump and, basically, the fate of democracy. Next month, it will hear arguments concerning the former guy\u2019s claims of immunity, which he hopes will result in the justices agreeing that presidents cannot be held responsible for their actions. As he has claimed in the past, Trump <a data-offer-url=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/112039040661602776\" class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/112039040661602776&quot;}\" href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/112039040661602776\" rel=\"noopener\" target=\"_blank\">wrote<\/a> on Truth Social today that unless presidents have total immunity from the law both while in office and after, they \u201cwill always be concerned, and even paralyzed, by the prospect of wrongful prosecution and retaliation, after they leave office. This could actually lead to extortion and blackmail of a President.\u2026 A President must be free to make proper decisions. His mind must be clear, and he must not be guided by fear of retribution!\u201d<\/p>\n<p class=\"paywall\">While it would be truly shocking\u2014<a href=\"https:\/\/www.vanityfair.com\/news\/scotus-may-keep-donald-trump-on-the-ballot-but-make-him-go-to-trial-for-that-whole-insurrection-business\" target=\"_blank\" rel=\"noopener\">and seemingly unlikely<\/a>\u2014for the Court to side with Trump\u2019s absurd immunity claims, as my colleague <strong>Eric Lutz<\/strong> <a href=\"https:\/\/www.vanityfair.com\/news\/supreme-court-to-hear-donald-trump-immunity-claim\" target=\"_blank\" rel=\"noopener\">noted<\/a> last month, the justices have <em>already<\/em> given the ex-president a win by (1) agreeing to hear the case and (2) scheduling arguments for late April, which will delay his federal election-subversion case until who knows when.
