{"id":77082,"date":"2024-02-19T12:19:10","date_gmt":"2024-02-19T12:19:10","guid":{"rendered":"https:\/\/entertainment.runfyers.com\/index.php\/2024\/02\/19\/eu-opens-formal-probe-of-tiktok-under-digital-services-act-citing-child-safety-risk-management-other-concerns-techcrunch\/"},"modified":"2024-02-19T12:19:10","modified_gmt":"2024-02-19T12:19:10","slug":"eu-opens-formal-probe-of-tiktok-under-digital-services-act-citing-child-safety-risk-management-other-concerns-techcrunch","status":"publish","type":"post","link":"https:\/\/entertainment.runfyers.com\/index.php\/2024\/02\/19\/eu-opens-formal-probe-of-tiktok-under-digital-services-act-citing-child-safety-risk-management-other-concerns-techcrunch\/","title":{"rendered":"EU opens formal probe of TikTok under Digital Services Act, citing child safety, risk management &#038; other concerns | TechCrunch"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p id=\"speakable-summary\">The European Union is formally investigating TikTok\u2019s compliance with the bloc\u2019s <a href=\"https:\/\/techcrunch.com\/2024\/02\/16\/eu-dsa-psa\/\" target=\"_blank\" rel=\"noopener\">Digital Services Act<\/a> (DSA), the Commission has announced.<\/p>\n<p>Areas the Commission is focusing on in this investigation of TikTok are linked to the protection of minors, advertising transparency, data access for researchers, and the risk management of addictive design and harmful content, in said in a <a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/ip_24_926\" target=\"_blank\" rel=\"noopener\">press release<\/a>.<\/p>\n<p>The DSA is the bloc\u2019s online governance and content moderation rulebook which, since Saturday, has applied broadly to \u2014 likely \u2014 thousands of platforms and services. But <a href=\"https:\/\/techcrunch.com\/2023\/08\/25\/quiet-qutting-ai\/\" target=\"_blank\" rel=\"noopener\">since last summer,<\/a> <a href=\"https:\/\/techcrunch.com\/2023\/04\/25\/europe-names-19-platforms-that-must-report-algorithmic-risks-under-dsa\/\" target=\"_blank\" rel=\"noopener\">larger platforms, such as TikTok,<\/a> have faced a set of extra requirements, in areas like algorithmic transparency and systemic risk, and it\u2019s those rules the video-sharing platform is now being investigated under.<\/p>\n<p>Penalties for confirmed breaches of the DSA can reach up to 6% of global annual turnover.<\/p>\n<p>Today\u2019s move follows several months of information gathering by the Commission, which enforces the DSA rules for larger platforms \u2014 including requests for information from TikTok in areas including <a href=\"https:\/\/techcrunch.com\/2023\/11\/09\/eu-asks-tiktok-and-youtube-for-more-info-on-how-theyre-safeguarding-kids\/\" target=\"_blank\" rel=\"noopener\">child protection<\/a> and <a href=\"https:\/\/techcrunch.com\/2023\/10\/19\/meta-tiktok-eu-rfi-dsa\/\" target=\"_blank\" rel=\"noopener\">disinformation risks<\/a>.<\/p>\n<p>Although the EU\u2019s concerns over TikTok\u2019s approach to content governance and safety <a href=\"https:\/\/techcrunch.com\/2023\/01\/10\/tiktok-eu-meeting\/\" target=\"_blank\" rel=\"noopener\">predate the DSA coming into force<\/a> on larger platforms. And TikTok was forced to make some operational tweaks before, back in <a href=\"https:\/\/techcrunch.com\/2022\/06\/22\/tiktok-eu-consumer-protection-commtiments\/\" target=\"_blank\" rel=\"noopener\">June 2022<\/a>, after regional consumer protection authorities banded together to investigate child safety and privacy complaints.<\/p>\n<p>The Commission will now step up its information requests to the video sharing platform as it investigates the string of suspected breaches. This could also include conducting interviews and inspections as well as asking it to send more data.<\/p>\n<p>There\u2019s no formal deadline for the EU to conclude these in-depth probe \u2014 its press release just notes the duration depends on several factors, such as \u201cthe complexity of the case, the extent to which the company concerned cooperates with the Commission and the exercise of the rights of defence\u201d.<\/p>\n<p>TikTok was contacted for comment on the formal investigation. A company spokesperson emailed us this statement:<\/p>\n<blockquote>\n<p><span class=\"il\">TikTok<\/span> has pioneered features and settings to protect teens and keep under 13s off the platform, issues the whole industry is grappling with. We\u2019ll continue to work with experts and industry to keep young people on <span class=\"il\">TikTok<\/span> safe, and look forward to now having the opportunity to explain this work in detail to the Commission.<\/p>\n<\/blockquote>\n<p>TikTok confirmed receipt of a document from the Commission setting out the EU\u2019s decision to open an investigation. The company also said it has responded to all previous Commission requests for information but has yet to receive any feedback about its responses. Additionally, TikTok said an earlier offer it made for its internal child safety staff to meet with Commission officials has yet to be taken up.<\/p>\n<p>In its press release, the Commission says the probe of TikTok\u2019s compliance with DSA obligations in the area of systemic risks will look at \u201cactual or foreseeable negative effects\u201d stemming from the design of its system, including algorithms. The EU says it\u2019s worried TikTok\u2019s UX may \u201cstimulate behavioural addictions and\/or create so-called \u2018rabbit hole effects&#8217;\u201d.<\/p>\n<p>\u201cSuch assessment is required to counter potential risks for the exercise of the fundamental right to the person\u2019s physical and mental well-being, the respect of the rights of the child as well as its impact on radicalisation processes,\u201d it further writes.<\/p>\n<p>The Commission is also concerned that\u00a0mitigation measures TikTok has put in place to protect kids from accessing inappropriate content \u2014 namely age verification tools \u2014 \u201cmay not be reasonable, proportionate and effective\u201d.<\/p>\n<p>The bloc will therefore look at whether TikTok is complying with \u201cDSA obligations to put in place appropriate and proportionate measures to ensure a high level of privacy, safety and security for minors, particularly with regard to default privacy settings for minors as part of the design and functioning of their recommender systems\u201d.<\/p>\n<p>Elsewhere, the EU\u2019s probe will assess whether TikTok is fulfilling the DSA requirement to provide \u201ca searchable and reliable repository\u201d for ads that run on its platform.<\/p>\n<p><a href=\"https:\/\/techcrunch.com\/2023\/07\/20\/tiktok-ads-transparency\/\" target=\"_blank\" rel=\"noopener\">TikTok only launched an ads library last summer<\/a> \u2014 ahead of the regulation\u2019s compliance deadline for larger platforms.<\/p>\n<p>Also on transparency, the Commission says its investigation concerns \u201csuspected shortcomings\u201d when it comes to TikTok providing researchers with access to publicly accessible data on its platform so they can study systemic risk in the EU \u2014 with such data access mandated by Article 40 of the DSA.<\/p>\n<p>Again, TikTok announced an expansion to its research API <a href=\"https:\/\/techcrunch.com\/2023\/07\/20\/tiktok-ads-transparency\/\" target=\"_blank\" rel=\"noopener\">last summer<\/a>. But, evidently, the bloc is concerned neither of these measures have gone far enough to fulfil the platform\u2019s legal requirements to ensure transparency.<\/p>\n<p>Commenting in a statement, Margrethe Vestager, EVP for digital, said:<\/p>\n<blockquote>\n<p>The safety and well-being of online users in Europe is crucial. TikTok needs to take a close look at the services they offer and carefully consider the risks that they pose to their users \u2013 young as well as old. The Commission will now carry out an in-depth investigation without prejudice to the outcome.<\/p>\n<\/blockquote>\n<p>In another supporting statement internal market commissioner, Thierry Breton, emphasized that: \u201cThe protection of minors is a top enforcement priority for the DSA.\u201d<\/p>\n<p>\u201cAs a platform that reaches millions of children and teenagers, TikTok must fully comply with the DSA and has a particular role to play in the protection of minors online,\u201d he added. \u201cWe are launching this formal infringement proceeding today to ensure that proportionate action is taken to protect the physical and emotional well-being of young Europeans. We must spare no effort to protect our children.\u201d<\/p>\n<p>It\u2019s the second such proceeding under the DSA, after the bloc opened a probe on Elon Musk-owned X (formerly Twitter) in <a href=\"https:\/\/techcrunch.com\/2023\/12\/18\/x-dsa-probe\/\" target=\"_blank\" rel=\"noopener\">December<\/a>, also citing a string of concerns. That investigation remains ongoing.<\/p>\n<p>Once an investigation has been opened EU enforcers can also access a broader toolbox, such as being able to take interim measures prior to a formal proceeding being wrapped up.<\/p>\n<p>The EU may also accept commitments offered by a platform under investigation if they are aimed at fixing the issues identified.<\/p>\n<p><a href=\"https:\/\/techcrunch.com\/2023\/12\/20\/pornhub-stripchat-xvideos-eu-vlops\/\" target=\"_blank\" rel=\"noopener\">Around<\/a> <a href=\"https:\/\/techcrunch.com\/2023\/04\/25\/europe-names-19-platforms-that-must-report-algorithmic-risks-under-dsa\/\" target=\"_blank\" rel=\"noopener\">two dozen platforms<\/a> are subject to the DSA\u2019s algorithmic transparency and systemic risk rules. These are defined as platforms with more than 45 million regional monthly active users.<\/p>\n<p>In TikTok\u2019s case the platform informed the bloc last year that it had 135.9M monthly active users in the EU.<\/p>\n<p>The Commission\u2019s decision to open a child protection investigation on TikTok means Ireland\u2019s media regulator, which is responsible for oversight of TikTok\u2019s compliance with the rest of DSA rules, under the decentralized, \u2018country of origin\u2019 enforcement structure the EU devised for enforcing the bulk of the regulation, won\u2019t be able to step in and supervise the platform\u2019s compliance in this area. It will be solely up to the Commission to assess whether or not TikTok<span style=\"font-size: 1rem; letter-spacing: -0.1px;\"> has put in place \u201cappropriate and proportionate measures to ensure a high level of privacy, safety, and security of minors\u201d.\u00a0<\/span><\/p>\n<p>In recent years, Ireland\u2019s data protection authority, which oversees TikTok\u2019s compliance with another major piece of EU digital law \u2014 aka, the bloc\u2019s General Data Protection Regulation \u2014 <a href=\"https:\/\/techcrunch.com\/2023\/05\/23\/tiktok-helen-dixon-libe-committee\/\" target=\"_blank\" rel=\"noopener\">has faced criticism from some EU lawmakers<\/a> for not acting swiftly enough on concerns about how the platform processes minors\u2019 data.<\/p>\n<\/p><\/div>\n<p><br \/>\n<br \/><a href=\"https:\/\/techcrunch.com\/2024\/02\/19\/tiktok-dsa-probe\/\" target=\"_blank\" rel=\"noopener\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The European Union is formally investigating TikTok\u2019s compliance with the bloc\u2019s Digital Services Act (DSA), the Commission has announced.
