In <a href=\"https:\/\/www.philips.com\/a-w\/about\/news\/archive\/corpcomms\/news\/press\/2024\/philips-fourth-quarter-results-2023.html\" target=\"_blank\" rel=\"noopener\">its earnings report<\/a> on Monday, the company says it will not sell new CPAP or BiPAP devices in the US until it meets the requirements outlined by the Food and Drug Administration.<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\"><a href=\"https:\/\/www.fda.gov\/medical-devices\/safety-communications\/update-certain-philips-respironics-ventilators-bipap-machines-and-cpap-machines-recalled-due\" target=\"_blank\" rel=\"noopener\">Philips first issued a recall<\/a> on its sleep apnea machines in 2021 over \u201cpotential health risks.\u201d The recall includes devices made between 2009 and April 21st, 2021, and stems from a polyester-based polyurethane foam Philips included in the machines to minimize sound and vibration. As noted by Philips, that foam \u201ccan break down,\u201d leading the person using the device to breathe it in or swallow it, resulting in potential injury.<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The company says it has reached a consent decree with the Department of Justice and FDA. It doesn\u2019t go into detail about the terms of the agreement because it is still pending approval by a court. However, we do know that Philips will still provide service to sleep and respiratory devices in the US and will also continue to sell the machines outside of the US.
