The Disrupt Explicit Forged Images and Non-Consensual Edits (DEFIANCE) Act would add a civil right of action for intimate \u201cdigital forgeries\u201d depicting an identifiable person without their consent, letting victims collect financial damages from anyone who \u201cknowingly produced or possessed\u201d the image with the intent to spread it.<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\"><a href=\"https:\/\/www.documentcloud.org\/documents\/24397944-defiance-act\" target=\"_blank\" rel=\"noopener\">The bill<\/a> was introduced by Senate Majority Whip Dick Durbin (D-IL), joined by Sens. Lindsey Graham (R-SC), Amy Klobuchar (D-MN), and Josh Hawley (R-MO). It builds on a provision in the <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2022\/03\/16\/fact-sheet-reauthorization-of-the-violence-against-women-act-vawa\/\" target=\"_blank\" rel=\"noopener\">Violence Against Women Act Reauthorization Act of 2022<\/a>, which added a similar right of action for <em>non-<\/em>faked explicit images. In a summary, the sponsors described it as a response to an \u201cexponentially\u201d growing volume of digitally manipulated explicit AI images, referencing Swift\u2019s case as an example of how the fakes can be \u201cused to exploit and harass women \u2014 particularly public figures, politicians, and celebrities.\u201d<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Pornographic AI-manipulated images, frequently referred to as deepfakes, have grown in popularity and sophistication since the term was <a href=\"https:\/\/www.vice.com\/en\/article\/gydydm\/gal-gadot-fake-ai-porn\" target=\"_blank\" rel=\"noopener\">coined in 2017<\/a>. Off-the-shelf generative AI tools have made them far easier to produce, even on systems with guardrails against explicit imagery or impersonation, and they\u2019ve been used for <a href=\"https:\/\/www.theverge.com\/2023\/6\/8\/23753605\/ai-deepfake-sextortion-nude-blackmail-fbi-warning\" target=\"_blank\" rel=\"noopener\">harassment and blackmail<\/a>. But so far, there\u2019s no clear legal redress in many parts of the US. Nearly all states have passed laws <a href=\"https:\/\/cybercivilrights.org\/faqs\/#current-state-laws\" target=\"_blank\" rel=\"noopener\">banning unsimulated nonconsensual pornography<\/a>, though it\u2019s been a slow process. Far fewer have <a href=\"https:\/\/www.law.com\/legaltechnews\/2023\/08\/10\/states-are-targeting-deepfake-pornography-but-not-in-a-uniform-way\/\" target=\"_blank\" rel=\"noopener\">laws addressing<\/a> simulated imagery. (There\u2019s no federal criminal law directly banning either type.) But it\u2019s part of President Joe Biden\u2019s AI regulation agenda, and White House press secretary Karine Jean-Pierre <a href=\"https:\/\/www.theverge.com\/2024\/1\/26\/24052261\/taylor-swift-ai-fakes-white-house-responds-legislation\" target=\"_blank\" rel=\"noopener\">called on Congress<\/a> to pass new laws in response to the Taylor Swift incident last week.<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The DEFIANCE Act was introduced in response to AI-generated images, but it\u2019s not limited to them. It counts a forgery as any \u201cintimate\u201d sexual image (a term defined in the underlying rule) created by \u201csoftware, machine learning, artificial intelligence, or any other computer-generated or technological means &#8230; to appear to a reasonable person to be indistinguishable from an authentic visual depiction of the individual.\u201d That includes real pictures that have been modified to look sexually explicit. Its language seemingly applies to older tools like Photoshop, as long as the result is sufficiently realistic. Adding a label marking the image as inauthentic doesn\u2019t remove the liability, either.<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Members of Congress have floated numerous bills addressing AI and nonconsensual pornography, and most have yet to pass. Earlier this month <a href=\"https:\/\/www.vice.com\/en\/article\/5d9az5\/congress-is-trying-to-stop-ai-nudes-and-deepfake-scams-because-celebrities-are-mad\" target=\"_blank\" rel=\"noopener\">lawmakers introduced<\/a> the No AI FRAUD Act, an <a href=\"https:\/\/www.techdirt.com\/2024\/01\/23\/was-the-no-ai-fraud-act-written-by-a-fraudulent-ai-because-whoever-wrote-it-is-hallucinating\/\" target=\"_blank\" rel=\"noopener\">extremely broad ban<\/a> on using tech to imitate someone without permission. A blanket impersonation rule raises huge questions about artistic expression, though; it could let powerful figures sue over political parodies, reenactments, or creative fictional treatments.
