At question is a legal doctrine called Chevron deference that allows federal agencies to interpret laws meant to protect consumers, public health, and the environment. Now, a conservative supermajority in the Supreme Court appears on the precipice of either overturning or limiting the scope of Chevron deference. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\"><em>The Verge<\/em> spoke with legal experts about what\u2019s going on and what the Supreme Court\u2019s decisions on Chevron deference could ultimately mean for Americans. \u201cThe real question is how far they will go?\u201d says Jody Freeman, director of the Environmental and Energy Law Program at Harvard. \u201cThey could in fact, overturn that precedent. The assumption is that the agency has more expertise on the matter than a federal judge assigned to the case.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The practice was already in place long before it had a name, according to Ian Fein, senior counsel at the nonprofit Natural Resources Defense Council. It came to be known as the Chevron doctrine after a 1984 case, <em>Chevron USA, Inc. v. Natural Resources Defense Council (NRDC). <\/em>The funny thing is that NRDC, an environmental group, actually lost the case, and the Supreme Court upheld a decision that favored Chevron. It allowed the Ronald Reagan era\u2019s industry-friendly Environmental Protection Agency to stick with its own lax interpretation of the Clean Air Act.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">But since then, Chevron deference has empowered agencies to take initiative on issues that legislation might not have caught up to yet, like climate change and broadband access. It\u2019s led to tussles, for instance, over <a href=\"https:\/\/www.theverge.com\/2022\/6\/28\/23186627\/supreme-court-climate-court-case-west-virginia-epa-power-plant-emissions\" target=\"_blank\" rel=\"noopener\">how far the EPA can go to regulate greenhouse gas emissions<\/a> under the Clean Air Act and <a href=\"https:\/\/arstechnica.com\/tech-policy\/2023\/10\/is-net-neutrality-doomed-at-supreme-court-fcc-and-isps-prepare-for-epic-battle\/\" target=\"_blank\" rel=\"noopener\">how far the FCC can go in mandating net neutrality<\/a>.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\"><strong>Why is the Supreme Court weighing in on it now? <\/strong><\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Despite initial support from conservative groups, Fein says the Chevron deference has become a target more recently for industries pushing a deregulatory agenda. \u201cThere has been this steady march in the last 10 years or so of a concerted effort to try to call the doctrine into question and to have it overruled,\u201d Fein tells <em>The Verge<\/em>. Around the second term of the Obama administration, Fein says, \u201cWe begin to see the notion of overturning Chevron deference as a way to cut back on federal agencies\u2019 ability to carry out federal law.\u201d <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Two cases have worked their way up to the Supreme Court that jeopardize the long-standing Chevron doctrine: <em>Loper Bright Enterprises v. Raimondo <\/em>and<em> Relentless, Inc. v. Department of Commerce.<\/em> Plaintiffs in both cases are challenging a rule that makes fishing companies pay for the cost of observers they\u2019re legally required to bring on their ships to monitor their operations. They\u2019re asking justices to overrule Chevron and have backing from other industry groups ranging from Gun Owners of America to e-cigarette manufacturers.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component clear-both block md:float-left md:mr-30 md:w-[320px] lg:-ml-100\">\n<div class=\"duet--article--article-pullquote mb-20\">\n<p class=\"duet--article--dangerously-set-cms-markup relative bg-repeating-lines-dark bg-[length:1px_1.2em] pb-8 font-polysans text-28 font-medium leading-120 tracking-1 selection:bg-franklin-20  dark:bg-repeating-lines-light dark:text-white dark:selection:bg-blurple\">\u201cIt\u2019s kind of hard to overstate just how widespread and foundational this principle has been to the operation of our federal government.\u201d<\/p>\n<\/div>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">\u201cJoe Biden \u2013 and his predecessors \u2013 used the wide authority given to them by Chevron deference to go after law-abiding gun owners on several different occasions,\u201d Gun Owners of America senior vice president Erich Pratt said in a <a href=\"https:\/\/www.gunowners.org\/goa-and-gof-file-amicus-brief-with-scotus-in-chevron-case\/\" target=\"_blank\" rel=\"noopener\">statement<\/a> last year.<strong> <\/strong>\u201cAmericans have had enough of one man with a pen going after our constitutionally guaranteed rights, and we urge the Court to reverse Chevron.\u201d\u00a0<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">If they\u2019re successful, they could force a total overhaul of how industries are regulated in the United States \u2014 taking power away from federal agencies and placing way more responsibility on federal courts. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">\u201cIt\u2019s kind of hard to overstate just how widespread and foundational this principle has been to the operation of our federal government,\u201d Fein says. \u201cIt described the ground rules or the foundation on which the system that we have [operates] \u2014\u00a0of federal agencies carrying out statutes and courts, they\u2019re the backstop.\u201d<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p happens if SCOTUS decides to overturn Chevron?<\/strong><\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin courts are deciding what they think all these laws mean,\u201d Freeman tells<em> The Verge<\/em>. \u201cAnd that can lead to a lot of inconsistency and confusion for agencies and for regulated parties.\u201d<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 href=\"https:\/\/news.harvard.edu\/gazette\/story\/2024\/01\/chevron-deference-faces-existential-test\/\" target=\"_blank\" rel=\"noopener\">interview<\/a> in <em>The<\/em> <em>Harvard Gazette<\/em> that breaks down how badly such a decision could muck up courts:<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<blockquote class=\"duet--article--blockquote jzbdts2\">\n<p class=\"duet--article--dangerously-set-cms-markup jzbdtsa jzbdts0\">Chevron does not matter much to the Supreme Court, which largely ignores it. But it does matter to the lower courts, which continue to use its two-step test to manage a flood of litigation challenging agency interpretations of every kind, from the most general to the most intricate. When statutes aren\u2019t clear, courts consider whether the agency interpretation is sensible, well-reasoned, and aligns with the statute\u2019s design. If so, the agency wins. Without Chevron, federal judges may get bogged down in intricate questions of statutory interpretation which require scientific, economic, or technological expertise. Policy choices that are better suited to agencies with research and information-gathering capacity, and obligations to consult stakeholders, will increasingly be made by federal judges, who have none of their expertise and do none of these things.\u00a0<\/p>\n<\/blockquote>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Even Trump-appointed justice Brett Kavanaugh acknowledged that throwing out Chevron deference could be a \u201cshock\u201d to the legal system during oral arguments on Wednesday, although he downplayed the effects of that shock in the long term. He brushed it off, saying there are \u201cshocks to the system every four or eight years when a new administration comes in, whether it\u2019s communications law or securities law or competition law or environmental law,\u201d <a href=\"https:\/\/www.nytimes.com\/2024\/01\/17\/us\/supreme-court-chevron-case.html\" target=\"_blank\" rel=\"noopener\"><em>The New York Times<\/em> reports<\/a>. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">While Chevron deference as we know it may not survive the 6-3 conservative supermajority in the Supreme Court, the justices could opt to set limits on when to grant deference rather than throwing out the doctrine altogether. \u201cEither way, it\u2019s a moment, I think, in which it will be harder for federal agencies to do the work that they have to do,\u201d Freeman says. That\u2019s why the stakes are so high,\u201d Freeman says. \u201cIt looks like the Supreme Court is becoming more and more powerful with respect to the other two branches.
