The three-member panel decided that despite denials by Google, which owns YouTube Music, and its subcontractor Cognizant, the two are, in fact, joint employers of the Austin-based workers who perform data-related tasks, like <a href=\"https:\/\/www.billboard.com\/pro\/youtube-music-workers-strike-union-return-to-office\/\" target=\"_blank\" rel=\"noopener\">finding errors<\/a> in its charts algorithm.\u00a0<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">\u201cAt all material times, Respondents Cognizant and Google have codetermined the essential terms and conditions of employment of employees employed at the E. Parmer Lane facility and have been joint employers,\u201d writes the board <a href=\"https:\/\/apps.nlrb.gov\/link\/document.aspx\/09031d4583c083ab\" target=\"_blank\" rel=\"noopener\">in its decision<\/a> (PDF).\u00a0<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Google\u2019s troubles with its YouTube Music contractors first began last year, after a group of 40 workers hired by Cognizant voted to join the <a href=\"https:\/\/www.theverge.com\/2023\/2\/3\/23585093\/youtube-music-contractors-strike-google-remote-work\" target=\"_blank\" rel=\"noopener\">Alphabet Workers Union<\/a>. Their chief concern was over YouTube Music\u2019s demand that the hourly workers return to their Austin, TX office instead of working remotely. The contractors, who are <a href=\"https:\/\/www.theverge.com\/2023\/2\/3\/23585093\/youtube-music-contractors-strike-google-remote-work\" target=\"_blank\" rel=\"noopener\">paid as little as $19 per hour<\/a> and include many <a href=\"https:\/\/www.billboard.com\/pro\/youtube-music-workers-strike-union-return-to-office\/\" target=\"_blank\" rel=\"noopener\">hired remotely<\/a>, argued that additional expenses for childcare and transportation meant returning to the office simply wasn\u2019t feasible.\u00a0<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">This is a familiar turn of events for Alphabet-owned Google. Back in November, the NLRB <a href=\"https:\/\/www.cnbc.com\/2023\/11\/07\/group-of-google-contractors-who-work-on-win-union-vote.html\" target=\"_blank\" rel=\"noopener\">issued<\/a> a similar ruling over a group of Bard and Search contractors who had voted to unionize \u2014 classifying both Google and Accenture as joint employers. Google opted then to appeal the NLRB\u2019s decision \u2014 and appears to be doing the same today: <em>Bloomberg <\/em><a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2024-01-04\/alphabet-illegally-refuses-to-negotiate-with-youtube-contract-staff-nlrb-rules?srnd=technology-vp&amp;sref=M8H6LjUF\" target=\"_blank\" rel=\"noopener\">reports<\/a> that the company plans to appeal the ruling in federal court.\u00a0<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">A new NLRB rule that took effect in December will make it even harder for companies like Google to argue they aren\u2019t responsible for dealing with unionization efforts by third-party contractors. That <a href=\"https:\/\/news.bloomberglaw.com\/daily-labor-report\/new-labor-board-joint-employer-test-replaces-pro-business-rule\" target=\"_blank\" rel=\"noopener\">replaced<\/a> a Trump-era rule on joint employers, effectively making it easier for unions to <a href=\"https:\/\/www.reuters.com\/legal\/business-groups-sue-us-labor-board-block-contract-franchise-worker-rule-2023-11-09\/\" target=\"_blank\" rel=\"noopener\">organize contract and franchise workers<\/a> \u2014 much to the chagrin of the major tech companies who have increasingly relied on them.
