Google lets anyone install any app on an Android phone. But guess which one of these two companies has an illegal monopoly, according to the courts?<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">As you probably already know, <a href=\"https:\/\/www.theverge.com\/23994174\/epic-google-trial-jury-verdict-monopoly-google-play\" target=\"_blank\" rel=\"noopener\">Google is the one that lost its fight against Epic Games this week<\/a>. It\u2019s a fight that Apple previously (mostly) won <a href=\"https:\/\/www.theverge.com\/2021\/9\/12\/22667694\/epic-v-apple-trial-fortnite-judge-yvonne-gonzalez-rogers-final-ruling-injunction-breakdown\" target=\"_blank\" rel=\"noopener\">in a similar trial in 2021<\/a>, beating claims that it had violated antitrust laws by charging mandatory in-app transaction fees and kicking Epic\u2019s game <em>Fortnite<\/em> off the App Store. Google tried a similar move, but in its case, a jury found it had maintained an unlawful monopoly with the Play store; a judge is scheduled to consider remedies next month.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Listening to the verdict live in the courtroom, I couldn\u2019t believe my ears at first. Readers <a href=\"https:\/\/www.theverge.com\/23994174\/epic-google-trial-jury-verdict-monopoly-google-play?showComments=1\" target=\"_blank\" rel=\"noopener\">in our comments<\/a> and around the internet felt the same.<em> How could Epic have possibly won <\/em>against the company that gives away its open-source operating system for free, especially after losing to that company\u2019s more locked-down competitor? <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Here\u2019s my set of theories \u2014 which I spent half an hour discussing <a href=\"https:\/\/www.theverge.com\/2023\/12\/15\/24002936\/today-on-the-vergecast-imessage-fortnite-threads-and-the-fight-for-the-soul-of-technology\" target=\"_blank\" rel=\"noopener\">on <em>The Vergecast<\/em><\/a> this week. <\/p>\n<\/div>\n<p><h4 class=\"duet--article--dangerously-set-cms-markup duet--article--standard-heading my-20 font-polysans text-24 font-light leading-110 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple md:text-26 [&amp;&gt;a:hover]:shadow-highlight-franklin dark:[&amp;&gt;a:hover]:shadow-highlight-franklin [&amp;&gt;a]:shadow-underline-black dark:[&amp;&gt;a]:shadow-underline-white\">1. Logistically, Epic v. Google is a fresh roll of the die.<\/h4>\n<\/p>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The court made it clear from day one: <em>Epic v. Google<\/em> is a different case from <em>Epic v. Apple<\/em>, with different evidence, in front of a different judge. Nothing in the Apple case is directly relevant to the Google case \u2014 in fact, the judge barred both sides from even bringing it up. Google\u2019s lawyers never got to argue to the jury that Apple won. Besides, Apple hasn\u2019t <em>quite<\/em> won yet: we\u2019re <a href=\"https:\/\/www.theverge.com\/2023\/9\/27\/23892853\/epic-games-apple-app-store-supreme-court-antitrust-trial\" target=\"_blank\" rel=\"noopener\">waiting for the Supreme Court to decide<\/a> whether it\u2019ll hear a final appeal. (I won&#8217;t be covering the Apple case more than the brief outline I&#8217;m giving you here, since I&#8217;m <a href=\"http:\/\/www.theverge.com\/authors\/sean-hollister#:~:text=Ethics%20statement%2C%20June%202023\" target=\"_blank\" rel=\"noopener\">ethically bound<\/a>.) Google has also said it <a href=\"https:\/\/www.theverge.com\/2023\/12\/11\/23996902\/google-will-appeal-the-epic-v-google-verdict\" target=\"_blank\" rel=\"noopener\">plans to appeal<\/a> the decision in its case.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Precedent obviously plays a role in the legal system, with judges following the guidance of things like Supreme Court rulings. But as Nilay Patel points out on <em>The Vergecast<\/em>, we shouldn\u2019t think of it as a deterministic algorithm \u2014 a new case is a fresh roll of the die.<\/p>\n<\/div>\n<p><h4 class=\"duet--article--dangerously-set-cms-markup duet--article--standard-heading my-20 font-polysans text-24 font-light leading-110 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple md:text-26 [&amp;&gt;a:hover]:shadow-highlight-franklin dark:[&amp;&gt;a:hover]:shadow-highlight-franklin [&amp;&gt;a]:shadow-underline-black dark:[&amp;&gt;a]:shadow-underline-white\">2. Google controls its ecosystem with third-party business deals, meaning unfair-looking documents are in more hands.<\/h4>\n<\/p>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Apple sells the iPhone. It\u2019s Apple\u2019s way or the highway, and has <a href=\"https:\/\/www.theverge.com\/c\/22611236\/epic-v-apple-emails-project-liberty-app-store-schiller-sweeney-cook-jobs\" target=\"_blank\" rel=\"noopener\">almost<\/a> always been. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Google doesn\u2019t sell the Samsung Galaxy phone lineup and didn\u2019t sell the Motorola Droid. It builds the Google ecosystem within Android by sharing a cut of its advertising and app store profits if phone makers agree to prominently carry its apps (like Chrome, Gmail, and Play), use its APIs, and issue timely security patches. Epic\u2019s lawyers could present details about these agreements and argue they showed Google using its power in one layer of the phone market to shut down competition in another.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">As we learned in this trial, Google also tried to offer major app and game developers deals to keep them from bypassing the Google Play Store \u2014 <a href=\"http:\/\/www.theverge.com\/23959932\/epic-v-google-trial-antitrust-play-store-fortnite-recap#:~:text=3.%20Project%20Hug%20targeted%20a%20who%E2%80%99s%20who%20of%20mobile%20game%20developers%20%E2%80%94%20and%2020%20of%20them%20signed.\" target=\"_blank\" rel=\"noopener\">like Project Hug<\/a>, which gave top game developers up to hundreds of millions of dollars worth of credits, co-marketing, and support. Paradoxically, the fact that Google allowed some competition created a paper trail of discussions about <a href=\"https:\/\/www.theverge.com\/2023\/11\/30\/23959241\/googles-biggest-play-priority-for-q1-2019-was-to-address-agitators-like-epic\" target=\"_blank\" rel=\"noopener\">how much of a potential threat that competition was<\/a>, including forecasts of <a href=\"https:\/\/www.theverge.com\/policy\/2023\/11\/7\/23951038\/the-contagion-effect\" target=\"_blank\" rel=\"noopener\">a \u201ccontagion effect\u201d<\/a> if game developers like Epic defected from Play.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Apple did face some awkward disclosures in its case too, <a href=\"https:\/\/www.theverge.com\/2021\/4\/9\/22375128\/apple-imessage-android-ecosystem-lock-in-epic-games-filings-app-store-dispute\" target=\"_blank\" rel=\"noopener\">like an internal email<\/a> referring to iMessage as a \u201cserious lock-in\u201d factor for iOS. But the <em>Epic v. Apple<\/em> trial included long digressions about topics like <a href=\"https:\/\/www.theverge.com\/2021\/5\/18\/22442395\/at-the-epic-trial-phil-schiller-got-away-clean\" target=\"_blank\" rel=\"noopener\">app store moderation<\/a>, giving lots of airtime to Apple\u2019s non-monopolistic rationales for a walled garden. While Epic argued that these rationales were merely a pretext for running a monopoly, <a href=\"https:\/\/www.theverge.com\/2021\/9\/12\/22667694\/epic-v-apple-trial-fortnite-judge-yvonne-gonzalez-rogers-final-ruling-injunction-breakdown\" target=\"_blank\" rel=\"noopener\">the ruling ended up<\/a> treating them as valid concerns, albeit with some skepticism. In an antitrust trial, intentions matter \u2014 and over the course of its many negotiations, Google wrote a <em>lot <\/em>of intentions down.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Epic Games CEO Tim Sweeney <a href=\"https:\/\/www.theverge.com\/23996474\/epic-tim-sweeney-interview-win-google-antitrust-lawsuit-district-court\" target=\"_blank\" rel=\"noopener\">told me<\/a> it\u2019s unfortunate that the more open company is getting penalized for that openness:<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<blockquote class=\"duet--article--blockquote jzbdts2\">\n<p class=\"duet--article--dangerously-set-cms-markup jzbdtsa jzbdts0\">I think Apple is&#8230; it\u2019s a little bit unfortunate that in a lot of ways Apple\u2019s restrictions on competition are absolute. Thou shalt not have a competing store on iOS and thou shalt not use a competing payment method. And I think Apple should be receiving at least as harsh antitrust scrutiny as Google<em>.<\/em><\/p>\n<\/blockquote>\n<\/div>\n<p><h4 class=\"duet--article--dangerously-set-cms-markup duet--article--standard-heading my-20 font-polysans text-24 font-light leading-110 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple md:text-26 [&amp;&gt;a:hover]:shadow-highlight-franklin dark:[&amp;&gt;a:hover]:shadow-highlight-franklin [&amp;&gt;a]:shadow-underline-black dark:[&amp;&gt;a]:shadow-underline-white\">3. Some of those deals looked seriously unfair!<\/h4>\n<\/p>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Putting aside Project Hug for a sec, Spotify <em>pays Google nothing<\/em> to get almost all the benefits of the Google Play store, we learned in court. I repeat: <a href=\"https:\/\/www.theverge.com\/2023\/11\/20\/23969690\/google-spotify-android-billing-commission-secret-deal\" target=\"_blank\" rel=\"noopener\">Spotify pays 0 percent<\/a> when it uses its own in-app payment system \u2014 while a competing subscription service might pay 11 percent of its revenue if it\u2019s even allowed to use its own payments system at all. \u201cIf you\u2019re a smaller developer than Spotify, you get screwed,\u201d Sweeney told me after the verdict.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Google <a href=\"https:\/\/www.theverge.com\/23954852\/google-netflix-app-store-deal-play-10-percent-revshare\" target=\"_blank\" rel=\"noopener\">offered Netflix a sweetheart deal<\/a> to pay just 10 percent of its earnings via Google Play too, at a time when 15 percent was the norm. (Netflix refused and decided not to stop offering in-app purchase on Google\u2019s store entirely.) <a href=\"http:\/\/www.theverge.com\/23959932\/epic-v-google-trial-antitrust-play-store-fortnite-recap#:~:text=9.%20This%20trial%20destroyed%20any%20notion%20that%20Google%20treats%20developers%20fairly%20and%20equally.\" target=\"_blank\" rel=\"noopener\">This trial destroyed any notion that Google treats developers fairly and equally<\/a>.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">And while Apple has <a href=\"https:\/\/www.theverge.com\/c\/22611236\/epic-v-apple-emails-project-liberty-app-store-schiller-sweeney-cook-jobs\" target=\"_blank\" rel=\"noopener\">offered developers sweetheart deals<\/a> too&#8230;<\/p>\n<\/div>\n<p><h4 class=\"duet--article--dangerously-set-cms-markup duet--article--standard-heading my-20 font-polysans text-24 font-light leading-110 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple md:text-26 [&amp;&gt;a:hover]:shadow-highlight-franklin dark:[&amp;&gt;a:hover]:shadow-highlight-franklin [&amp;&gt;a]:shadow-underline-black dark:[&amp;&gt;a]:shadow-underline-white\">4. This case was in front of a jury, not a bench trial.<\/h4>\n<\/p>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">That meant Epic could spin a tale of good and evil, while Google was left explaining away complicated business deals. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Epic showed the jury document after unfair-looking document where Google allegedly \u201cbribed\u201d or \u201cblocked\u201d its partners from becoming competitors with special deals, ones which at least disincentivized them from building, joining, or carrying alternative app stores, I\u2019d argue. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">While a judge might have well decided those deals aren\u2019t out of the norm, the jury may have seen how the sausage is made for the very first time \u2014 and the jury was ultimately in charge.<\/p>\n<\/div>\n<p><h4 class=\"duet--article--dangerously-set-cms-markup duet--article--standard-heading my-20 font-polysans text-24 font-light leading-110 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple md:text-26 [&amp;&gt;a:hover]:shadow-highlight-franklin dark:[&amp;&gt;a:hover]:shadow-highlight-franklin [&amp;&gt;a]:shadow-underline-black dark:[&amp;&gt;a]:shadow-underline-white\">5. That jury saw Google had something to hide.<\/h4>\n<\/p>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Not only did Google have to explain that offering a game developer, <a href=\"https:\/\/www.theverge.com\/2023\/11\/29\/23981427\/heres-the-90-million-deal-google-offered-riot-games\" target=\"_blank\" rel=\"noopener\">say, $90 million in incentives<\/a> wasn\u2019t necessarily a bribe, the Google executives behind those deals had to explain they weren\u2019t doing it to keep those companies from building rival app stores. Google employee after Google employee said they were doing it so Android phones could compete with the iPhone. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">But Google\u2019s own internal emails and strategic plans <a href=\"http:\/\/www.theverge.com\/23959932\/epic-v-google-trial-antitrust-play-store-fortnite-recap#:~:text=6.%20Google%20execs%20clearly%20wanted%20to%20block%20other%20app%20stores.\" target=\"_blank\" rel=\"noopener\">clearly showed that those execs wanted to block rival app stores<\/a>, and the jury was here for it. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The jury was also in the room for two rounds of weirdness with the Spotify numbers in particular, which Google <em>tried hard<\/em> not to reveal in open court. It doesn\u2019t sell those directly, for one thing, and you can buy an iPhone instead. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Google wanted to argue the \u201crelevant antitrust market\u201d was phones and app stores in general \u2014 or <a href=\"https:\/\/www.theverge.com\/2023\/11\/29\/23981169\/why-i-think-google-is-keen-on-tuckers-market-definition\" target=\"_blank\" rel=\"noopener\">better yet, mobile transactions<\/a>.
