On Thursday, <a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-secures-25-million-landmark-agreement-apple-resolve-employment\" target=\"_blank\" rel=\"noopener\">the Department of Justice announced<\/a> that $18.25 million will go toward creating a backpay fund for affected victims, while the remaining $6.75 million is in civil penalties.<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The DOJ found that Apple violated the Immigration and Nationality Act when recruiting through a permanent labor certification program (PERM), which lets companies hire foreign workers permanently in the US. When recruiting workers for this program, the DOJ says Apple didn\u2019t advertise openings on its website \u201ceven though its standard practice was to post other job positions on this website.\u201d<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The DOJ also found that Apple only accepted PERM position applications through the mail and \u201cdid not consider certain applications\u201d from existing Apple employees if they were sent electronically. \u201cThese less effective recruitment procedures nearly always resulted in few or no applications to PERM positions from applicants whose permission to work does not expire,\u201d the DOJ says.<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Apple denies engaging in illegal hiring practices in the <a href=\"https:\/\/www.justice.gov\/d9\/2023-11\/ier-apple_settlement_agreement_signed_2023-11-08_fully_executed.pdf\" target=\"_blank\" rel=\"noopener\">terms of the settlement<\/a>. \u201cWhen we realized we had unintentionally not been following the DOJ standard, we agreed to a settlement addressing their concerns,\u201d Apple spokesperson Fred Sainz said in an emailed statement to <em>The Verge<\/em>. \u201cWe have implemented a robust remediation plan to comply with the requirements of various government agencies as we continue to hire American workers and grow in the U.S.\u201d<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">In addition to the up to $25 million fine, the DOJ requires that Apple \u201cconduct more expansive recruitment for all PERM positions\u201d by posting PERM positions on its job website and accepting applications digitally. The DOJ says Apple has already addressed some of these issues. <\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Aside from Apple, <a href=\"https:\/\/www.theverge.com\/2023\/8\/24\/23844450\/doj-spacex-lawsuit-hiring-discrimination\" target=\"_blank\" rel=\"noopener\">the DOJ also hit SpaceX<\/a> with a hiring discrimination lawsuit, alleging the Elon Musk-owned company refused to hire asylum seekers and refugees.
