After hearing more than an hour of oral arguments Tuesday, a majority of the Court <a href=\"https:\/\/www.nbcnews.com\/politics\/supreme-court\/supreme-court-hears-major-gun-case-right-accused-domestic-abusers-poss-rcna123799\" target=\"_blank\" rel=\"noopener\">signaled<\/a> that the law aligns with firearm restrictions historically imposed on potentially dangerous individuals. The case marks the first time the Court has revisited Second Amendment rights since its <a href=\"https:\/\/www.vanityfair.com\/news\/2022\/06\/scotus-smashes-whats-left-of-separation-between-church-and-state\" target=\"_blank\" rel=\"noopener\">landmark decision<\/a> last year that drastically limited the government\u2019s ability to restrict access to firearms.<\/p>\n<p>In her <a href=\"https:\/\/www.supremecourt.gov\/oral_arguments\/argument_transcripts\/2023\/22-915_6jgm.pdf\" target=\"_blank\" rel=\"noopener\">opening statement<\/a>, Solicitor General <strong>Elizabeth Prelogar<\/strong> explained that \u201cCongress designed [the law] to target the most dangerous domestic abusers,\u201d referencing the portion of the <a data-offer-url=\"https:\/\/www.govinfo.gov\/content\/pkg\/COMPS-10824\/pdf\/COMPS-10824.pdf\" class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.govinfo.gov\/content\/pkg\/COMPS-10824\/pdf\/COMPS-10824.pdf&quot;}\" href=\"https:\/\/www.govinfo.gov\/content\/pkg\/COMPS-10824\/pdf\/COMPS-10824.pdf\" rel=\"nofollow noopener\" target=\"_blank\">1994 Violence Against Women Act<\/a> that bars those subjected to domestic violence restraining orders from possessing or purchasing guns.\u00a0\u201cThat principle is firmly grounded in the Second Amendment\u2019s history and tradition,\u201d Prelogar said. \u201cThroughout our nation\u2019s history, legislatures have disarmed those who have committed serious criminal conduct or whose access to guns poses a danger.\u201d<\/p>\n<p class=\"paywall\">The law has <a href=\"https:\/\/www.pbs.org\/newshour\/amp\/nation\/a-domestic-violence-survivor-wants-the-supreme-court-to-uphold-a-gun-control-law\" target=\"_blank\" rel=\"noopener\">reportedly<\/a> been used to block more than 77,000 firearm sales. But its constitutionality was questioned by <strong>Zackey Rahimi,<\/strong> a Texas man who was indicted for unlawfully possessing a gun while under a restraining order. Rahimi, despite pleading guilty to federal charges, argued that his Second Amendment rights had been violated. His case eventually reached the Fifth Circuit Court of Appeals, where the notably conservative bench tossed out his federal conviction, striking down the relevant portion of the 1994 law.\u00a0<\/p>\n<p class=\"paywall\">The Fifth Circuit ruling, which the Supreme Court agreed to hear in June after an appeal from the Justice Department, took place in the shadow of last year\u2019s <em>New York State Rifle &amp; Pistol Association v. Bruen.<\/em> In a 6-3 decision, the Supreme Court ruled in <em>Bruen<\/em> that modern laws must be consistent with the nation\u2019s \u201chistorical tradition\u201d of limited firearm regulations.<\/p>\n<p class=\"paywall\">Citing that test, the Fifth Circuit <a data-offer-url=\"https:\/\/casetext.com\/case\/united-states-v-rahimi-12\" class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/casetext.com\/case\/united-states-v-rahimi-12&quot;}\" href=\"https:\/\/casetext.com\/case\/united-states-v-rahimi-12\" rel=\"nofollow noopener\" target=\"_blank\">said<\/a> the restraining order ban \u201cfalls outside the class of firearm regulations countenanced by the Second Amendment.\u201d <strong>J. Matthew Wright,<\/strong> a public defender who represents Rahimi, made a similar argument Tuesday after liberal justice <strong>Elena Kagan<\/strong> asked whether he believes the government has \u201cno right\u201d to pass new gun restrictions absent specific historical precedence. \u201cYour honor, I think that\u2019s largely what <em>Bruen<\/em> says,\u201d Wright replied, adding, \u201cIf the government could affirmatively prove from the historical tradition of either American firearms laws\u2026if they could tie it to one of those historical traditions, that would be good enough under the logic of <em>Bruen,<\/em> if not the exact rule.\u201d<\/p>\n<p class=\"paywall\">As for the Court\u2019s conservatives, they seem inclined to adopt a narrow approach to the Rahimi case that would not conflict with the post-<em>Bruen<\/em> expansion of Second Amendment rights and the \u201chistorical\u201d test. For instance, Justice <strong>Amy Coney Barrett,<\/strong> a conservative who sided with the majority in <em>Bruen,<\/em> signaled her agreement with Prelogar by saying there was a historical tradition that shows \u201cthe legislature can make judgments to disarm people consistently with the Second Amendment based on dangerousness.\u201d<\/p>\n<p class=\"paywall\">Prelogar, for her part, used her closing statement to warn that the <em>Bruen<\/em> decision has generated \u201cdestabilizing consequences\u201d for lower courts, adding that there were insufficient \u201chistorical\u201d analogs to support disarming criminals convicted of aggravated assault, drug trafficking, and armed robbery.<\/p>\n<p class=\"paywall\">A ruling in <em>United States v.
