But by numerous accounts, he actually was quite intoxicated on election night 2020. Why are we bringing this up now? Because the former mayor\u2019s alleged inebriation\u2014and what <strong>Donald Trump<\/strong> knew about it\u2014may play a key role in the ex-president\u2019s federal trial on charges of trying to overturn the 2020 election results.<\/p>\n<p><em>Rolling Stone<\/em> <a href=\"https:\/\/www.rollingstone.com\/politics\/politics-features\/rudy-giuliani-jack-smith-donald-trump-jan6-1234814129\/\" target=\"_blank\" rel=\"noopener\">reports<\/a> that investigators working for Special Counsel <strong>Jack Smith<\/strong> have \u201crepeatedly grilled\u201d witnesses about\u00a0Giuliani\u2019s drinking on and after Election Day, how drunk he allegedly was when he was giving the then president advice on how to stay in power, and what Trump\u2019s awareness was of his attorney\u2019s sobriety or lack thereof. Among other things, Smith\u2019s team has reportedly asked witnesses \u201cif Trump had ever gossiped with them about Giuliani\u2019s drinking habits, and if Trump had ever claimed Giuliani\u2019s drinking impacted his decision-making or judgment.\u201d They\u2019ve also reportedly inquired \u201cabout whether the then president was warned, including after election night 2020, about Giuliani\u2019s allegedly excessive drinking,\u201d or if Trump was told that Giuliani was giving him \u201cpost-election legal and strategic advice while inebriated.\u201d<\/p>\n<p class=\"paywall\">Obviously, being tipsy or even shit-faced is not necessarily a crime\u2014and the Feds are not actually interested in Giuliani\u2019s drinking in and of itself. Rather, as attorneys and witnesses familiar with the matter told <em>Rolling Stone,<\/em> \u201cSmith and his team are interested in this subject because it could help demonstrate that Trump was implementing the counsel of somebody he knew to be under the influence and perhaps not thinking clearly. If that were the case, it could add to federal prosecutors\u2019 argument that Trump behaved with willful recklessness in his attempts nullify the 2020 election.\u201d Given that Trump\u2019s current legal team <a href=\"https:\/\/www.vanityfair.com\/news\/2023\/08\/donald-trump-election-indictment-defense\" target=\"_blank\" rel=\"noopener\">reportedly<\/a> plans to argue that Trump had just been taking his lawyers\u2019 advice after the election, evidence that he knew Giuliani was three sheets to the wind would likely undermine such an argument.<\/p>\n<p class=\"paywall\">\u201cIn order to rely upon an \u2018advice of counsel\u2019 defense, the defendant has to, number one, have made full disclosure of all material facts to the attorney,\u201d <strong>Mitchell Epner,<\/strong> a former assistant United States attorney, told <em>Rolling Stone.<\/em> \u201cThat requires that the attorney understands what\u2019s being told to them. If you know that your attorney is drunk, that does not count as making full disclosure of all material facts.\u201d<\/p>\n<p class=\"paywall\">As for the question of whether or not Giuliani was, in fact, drunk on election night and the days that followed, the answer seems to depend on who you ask: Rudy Giuliani or anyone else. The former mayor has <a href=\"https:\/\/www.vanityfair.com\/news\/2022\/06\/rudy-giuliani-january-6-committee-hearing-drunk-denial-diet-pepsi\" target=\"_blank\" rel=\"noopener\">denied<\/a> advising Trump while drunk, insisting in since-deleted tweets last year that he \u201cREFUSED all alcohol\u201d on election night and that his \u201cfavorite drink [is] Diet Pepsi,\u201d and in a statement, <strong>Ted Goodman<\/strong>, a political adviser advisers to Giuliani, said: &#8220;One should always question a story that is completely reliant on anonymous sources. This false narrative by nameless sources has been contradicted by on-the-record witnesses.&#8221; \u00a0Yet advisers to Trump told the January 6 committee that the ex-mayor was indeed plastered, with one saying Giuliani was \u201cdefinitely intoxicated\u201d while talking to Trump on the evening of November 3, 2020.<\/p>\n<div aria-label=\"social media post\" class=\"TwitterEmbedContainer-ggEzfU fHwbKp\">\n<div class=\"MessageBannerWrapper-krrtvl YIGPO ConsentBannerWrapper-bMdLtU WTFWJ\" data-testid=\"message-banner\">\n<div class=\"BaseWrap-sc-gjQpdd BaseText-ewhhUZ MessageBannerContent-gLUJfX iUEiRd jyISiS hloGrW\">\n<h4 class=\"ConsentBannerTitle-lgaGAH gOfech\">Twitter content<\/h4>\n<p>This content can also be viewed on the site it <a href=\"https:\/\/twitter.com\/therecount\/status\/1536367160376836100\" target=\"_blank\" rel=\"nofollow noreferrer noopener\" class=\"BaseWrap-sc-gjQpdd BaseText-ewhhUZ BaseLink-eNWuiM ConsentBannerLink-dJZMSz iUEiRd jyISiS joAuXZ\">originates<\/a> from.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<p class=\"paywall\">In addition to that testimony,\u00a0<em>Washington Post<\/em>\u00a0reporters\u00a0<strong>Carol Leonnig<\/strong>\u00a0and\u00a0<strong>Philip Rucker<\/strong>\u00a0<a href=\"https:\/\/www.vanityfair.com\/news\/2021\/07\/eric-trump-election-night-votes\" target=\"_blank\" rel=\"noopener\">wrote<\/a>\u00a0in their book\u00a0<em>I Alone Can Fix It<\/em>\u00a0that observers believed Giuliani had had too much to drink on election night, while author\u00a0<strong>Michael Wolff<\/strong>\u00a0<a href=\"https:\/\/www.youtube.com\/watch?v=q7swKyqo7LI&amp;t=58s\" target=\"_blank\" rel=\"noopener\">told<\/a>\u00a0MSNBC of the evening: \u201cRudy was incredibly drunk, weaving this way and that way\u2026.
