So for the last couple weeks, the North Dakota governor\u2019s presidential campaign started offering $20 gift cards\u2014or as Burgum calls them, \u201cBiden economic relief cards\u201d\u2014to the first 50,000 people who donated $1 to his fledgling campaign. Fully paid out, the gambit would cost the campaign a million dollars, but it also achieved its goal: On Wednesday, the North Dakota governor announced that his campaign surpassed the donor threshold to make it on the debate stage in the GOP presidential primary. \u200b\u200b\u201cWe passed the 40,000 mark today. We\u2019ve got more gift cards to give out. We\u2019re going to keep on going,\u201d Burgum said in <a href=\"https:\/\/www.cnn.com\/2023\/07\/19\/politics\/doug-burgum-primary-debate-fundraising\/index.html\" target=\"_blank\" rel=\"noopener\">an interview with CNN<\/a>, adding that his campaign has received donations from individuals in all 50 states.<\/p>\n<p>As for criticism that he is paying to play, Burgum turned to some campaign spin: \u201cI think that\u2019s funny actually,\u201d he said. \u201cThis is about a smart strategy, it\u2019s about an entrepreneur with a business attitude.\u201d<\/p>\n<p class=\"paywall\">Burgum is not the only Republican presidential candidate desperate for individual donors. They shouldn\u2019t.\u201d<\/p>\n<p class=\"paywall\">Forcing candidates to meet a donor threshold is not a novel idea; the Democratic Party imposed a similar standard in 2020, which initially locked out billionaire <strong>Michael Bloomberg,<\/strong> among other candidates, from early debates before the qualifying standard <a href=\"https:\/\/www.cnn.com\/2020\/01\/31\/politics\/dnc-requirements-nevada-debate\/index.html\" target=\"_blank\" rel=\"noopener\">was ultimately dropped<\/a>. But Republican presidential hopefuls certainly seem to be pushing the boundaries of legal tactics.<\/p>\n<p class=\"paywall\"><strong>Brendan Fischer,<\/strong> the executive director of political watchdog group Documented, explains that these ploys to get grassroots donors could set a \u201cbad precedent, because campaign funds are not supposed to be used as a piggy bank to hand out financial benefits to friends and supporters.\u201d <a data-offer-url=\"https:\/\/www.fec.gov\/updates\/contributions-in-the-name-of-another-are-strictly-prohibited\/\" class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.fec.gov\/updates\/contributions-in-the-name-of-another-are-strictly-prohibited\/&quot;}\" href=\"https:\/\/www.fec.gov\/updates\/contributions-in-the-name-of-another-are-strictly-prohibited\/\" rel=\"nofollow noopener\" target=\"_blank\">Federal campaign laws prohibit straw donors<\/a>\u2014in other words, it\u2019s illegal to reimburse someone for making campaign donations. Some legal experts question whether this is what these Republicans are essentially doing: \u201cGiving a donor a $20 gift card for donating seems a bit like that,\u201d <strong>Michael S. Kang,<\/strong> a professor at <a data-offer-url=\"https:\/\/www.law.northwestern.edu\/faculty\/profiles\/michaelseokhyunkang\/\" class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.law.northwestern.edu\/faculty\/profiles\/michaelseokhyunkang\/&quot;}\" href=\"https:\/\/www.law.northwestern.edu\/faculty\/profiles\/michaelseokhyunkang\/\" rel=\"nofollow noopener\" target=\"_blank\">Northwestern University\u2019s Pritzker School of Law<\/a>, <a href=\"https:\/\/www.npr.org\/2023\/07\/11\/1186991717\/doug-burgum-gift-cards-gop-republican-primary-debate\" target=\"_blank\" rel=\"noopener\">told NPR<\/a>. If not illegal, it seems at the very least a bit unethical. Fischer echoed the sentiment. Burgum\u2019s gift card scheme \u201craises a number of potential legal issues,\u201d he says. \u201cBurgum\u2019s campaign should likely have asked the FTC for an advisory opinion before proceeding\u2014questions about whether it might violate the straw donor ban or whether it might violate the <a data-offer-url=\"https:\/\/www.fec.gov\/help-candidates-and-committees\/making-disbursements\/personal-use\/\" class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.fec.gov\/help-candidates-and-committees\/making-disbursements\/personal-use\/&quot;}\" href=\"https:\/\/www.fec.gov\/help-candidates-and-committees\/making-disbursements\/personal-use\/\" rel=\"nofollow noopener\" target=\"_blank\">personal use ban<\/a>.\u201d\u00a0(<em>Vanity Fair<\/em> has reached out to Burgum\u2019s campaign for comment.)<\/p>\n<p class=\"paywall\">So far, Trump, <strong>Ron DeSantis, Nikki Haley, Chris Christie, Tim Scott,<\/strong> and Ramaswamy are on track to qualify for the debates, based upon their standing in recent polls and donations, as <a href=\"https:\/\/www.politico.com\/news\/2023\/07\/18\/trump-5-rivals-qualify-for-first-gop-debate-00106826\" target=\"_blank\" rel=\"noopener\">reported by Politico<\/a>. But other pretty notable names have not. Reportedly among them is former vice president <strong>Mike Pence.<\/strong> In an interview with Fox News on Tuesday morning, Pence addressed that his campaign was still short on donors\u2014and also seemed to take a shot at his opponents adopting, shall we say, <em>interesting<\/em> tactics to entice donors. \u201cFrom a polling standpoint, we\u2019ll easily qualify.
