\t\t\t\t<\/p>\n \t\t\t\t\t\t\t\t<\/p>\n Samsung wants Dua Lipa<\/strong><\/a>\u2018s lawsuit thrown out. <\/p>\n The 31-year-old sued the tech company back in May<\/a> for $15 million over them using her image on their packaging, accusing them of using her image to sell TVs without her permission. <\/p>\n In a new filing on Thursday (September 10), Samsung is asking a judge to dismiss the suit and say Dua<\/strong> can\u2019t sue over her photo being used, according to Billboard<\/a><\/em>. <\/p>\n \u201cDefendants respectfully request that the court dismiss the complaint in its entirety,\u201d the company\u2019s lawyers said in their latest filing. <\/p>\n They say she lacks trademark rights to her likeness, and potential customers were not tricked into thinking she endorsed the brand. Samsung argues that Dua<\/strong>\u2018s photo appears alongside other logos, like MLB and Fox Sports.<\/p>\n \u201cAn interface depicting a music-video channel among several unrelated content icons conveys nothing suggesting plaintiff endorses the televisions,\u201d Samsung\u2019s lawyers say. \u201cThe images merely depict the televisions\u2019 on-screen interface, illustrating the applications and \u2026 an example of content available on the TV.\u201d<\/p>\n On their part, Samsung is blaming a \u201ccontent partner\u201d for providing assurance that they could use her photo, and that it\u2019s only designed to show what kind of programming is available on their TVs. <\/p>\n \u201cThe image was used only after receiving explicit assurance from the content partner that permission had been secured, including for the retail boxes,\u201d the company wrote earlier this summer when the lawsuit was filed. \u201cGiven this assurance, we deny any allegations of intentional misuse.\u201d<\/p>\n Now, they argue that the accusations were legally deficient and should be dismissed for a number of reasons, including that Dua Lipa<\/strong> has no likeness rights to enforce given that she lives in England.<\/p>\n \u201cThe complaint\u2019s right of publicity causes of action fail to state a claim because \u2026 English law must apply, and England does not recognize a right of publicity,\u201d the company stated.<\/p>\n \u201cSamsung\u2019s response has been dismissive and callous, and the Infringing Products remain on the market to this day,\u201d Dua<\/strong>\u2018s lawyers say. \u201cSamsung\u2019s infringing conduct \u2014 using Ms. Lipa<\/strong>\u2019s assets for zero consideration \u2014 makes a mockery of her hard work.\u201d<\/p>\n When Dua<\/strong> filed her lawsuit in May, she and her lawyers said Samsung profited off of using her image<\/a>, for which she owns the copyright, on their packaging, and even quoted several X\/Twitter posts of people saying her image being used was convincing them to buy the TV.<\/p>\n \u201cMs. Lipa<\/strong>\u2019s face was prominently used for a mass marketing campaign for a consumer product without her knowledge, without consideration, and as to which she had no say, control, or input whatsoever,\u201d the lawyers previously said in the lawsuit. \u201cMs. Lipa<\/strong> did not allow and would not have allowed this use.\u201d<\/p>\n Posted To:Dua Lipa<\/a><\/p>\n<\/p><\/div>\n![\"Photo](\"https:\/\/www.justjared.com\/wp-content\/uploads\/2026\/09\/samsung-tv-display-788x525.jpg\")
