They are going to make those decisions when in court.\u201d<\/p>\n<blockquote class=\"instagram-media\" data-instgrm-permalink=\"https:\/\/www.instagram.com\/reel\/DYqF_BOSvP3\/?utm_source=ig_embed&amp;utm_campaign=loading\" data-instgrm-version=\"14\" style=\" background:#FFF; border:0; border-radius:3px; box-shadow:0 0 1px 0 rgba(0,0,0,0.5),0 1px 10px 0 rgba(0,0,0,0.15); margin: 1px; max-width:540px; min-width:326px; padding:0; width:99.375%; width:-webkit-calc(100% - 2px); width:calc(100% - 2px);\"\/>\n<p>Court filings previously described surveillance video that allegedly shows Robinson scouting the area around Utah Valley University before returning with a rifle. <\/p>\n<p>Prosecutors also claim the footage captures the shooting and Robinson\u2019s subsequent flight into a nearby wooded area, where investigators later recovered a rifle wrapped in a towel.<\/p>\n<p>Authorities have also alleged that investigators found ammunition and a tool used to etch markings into bullet casings at Robinson\u2019s home.<\/p>\n<p>Perhaps most notably, prosecutors claim Robinson confessed to the crime on four separate occasions, including in a note allegedly left for his roommate and romantic partner.<\/p>\n<p>\u201cI had the opportunity to take out Charlie Kirk, and I took it,\u201d the note reportedly states.<\/p>\n<p>Prosecutors have also said independent DNA testing conducted by federal agencies allegedly linked Robinson to the recovered rifle, the towel and a screwdriver connected to the investigation.<\/p>\n<p>Utah prosecutors have announced they intend to <a href=\"https:\/\/www.thehollywoodgossip.com\/2025\/10\/tyler-robinson-accused-charlie-kirk-killer-scores-surprising-legal-win\/\" target=\"_blank\" rel=\"noreferrer noopener\">seek the death penalty for Robinson<\/a>.<\/p>\n<p>Although she was not required to appear in court, Erika decided to attend the proceedings alongside Charlie Kirk\u2019s parents, Robert and Kathryn Kirk.<\/p>\n<p>A source close to the family told <a href=\"https:\/\/www.ms.now\/news\/tyler-robinson-charlie-kirk-preliminary-hearing\" target=\"_blank\" rel=\"noreferrer noopener\">MS Now<\/a> they felt compelled to attend \u201cto bear witness.\u201d<\/p>\n<blockquote class=\"instagram-media\" data-instgrm-permalink=\"https:\/\/www.instagram.com\/reel\/DXuYBCJicZp\/?utm_source=ig_embed&amp;utm_campaign=loading\" data-instgrm-version=\"14\" style=\" background:#FFF; border:0; border-radius:3px; box-shadow:0 0 1px 0 rgba(0,0,0,0.5),0 1px 10px 0 rgba(0,0,0,0.15); margin: 1px; max-width:540px; min-width:326px; padding:0; width:99.375%; width:-webkit-calc(100% - 2px); width:calc(100% - 2px);\"\/>\n<p>Erika has already played an active role in the legal proceedings through her attorney.
