TMZ<\/a><\/em> reports that James Heerdegen, Ricci\u2019s ex-husband, filed for an emergency hearing.<\/p>\nHe argued that the current custody arrangement over their son, Freddie, is untenable.<\/p>\n
According to his court filing, their tween son, Freddie, contacted him about Ricci\u2019s conduct during a recent flight.<\/p>\n
On June 16, Ricci and Freddie flew to Canada. <\/p>\n
Ricci allegedly drank during the journey.<\/p>\n
\nFreddie spoke to his own legal representative, and \u201cadvised that he \u2018overreacted\u2019 in sending those text messages to his father.\u201d<\/p>\n
The tween, who turns 12 this August, shared \u201cthat the description of Ms. Ricci\u2019s alcohol consumption and behavior thereafter was not as he had described.\u201d<\/p>\n
Perhaps most importantly, Freddie informed his counsel that he has \u201cno fear in continuing to be\u201d in his mother\u2019s custody.<\/p>\n
James\u2019 demand for alcohol testing for Ricci was denied by the court.<\/p>\n
Additionally, Freddie\u2019s attorney cautioned that \u201cthere is a real threat that public access to the statements and records may jeopardize the stability of Freddie\u2019s mental health.\u201d<\/p>\n
\nWhat happened?<\/h2>\n
This sounds like legal speak<\/em> for a pretty common incident that does not normally make its way into legal filings.<\/p>\nAn 11-year-old on a flight with his mom could, hypothetically, find her behavior a little annoying, especially if she drinks on a flight rather than rawdog the experience.<\/p>\n
Like many children of divorce, he might be in close contact with both parents, and complain about it to his dad.<\/p>\n
Hypothetically, a father with a legal history of outrageous behavior who has been accused of physical and emotional abuse might try to seize this as an opportunity to wrest custody away from his ex-wife.<\/p>\n
Upon realizing that his offhand comments, which almost any tween might make without the life experience to understand how his words might be used, one such 11-year-old might hastily inform the court that things are fine.<\/p>\n
\nIn July of 2020, Ricci filed to divorce Heerdegen.<\/p>\n
She accused him of \u201csevere physical and emotional abuse\u201d during their marriage.<\/p>\n
In her divorce filing, she also alleged that \u201cmany of these acts of abuse\u201d took place in front of their son, Freddie.<\/p>\n
Freddie was only 5 years old at the time of his parents\u2019 divorce filing.<\/p>\n
Fortunately, Ricci has moved on, marrying hair stylist Mark Hampton. The two have even welcomed a daughter together.<\/p>\n
Believe kids. But that also means believing them when they clarify, through their own legal representative, that complaining about a flight with their mom isn\u2019t a cry for help.<\/p>\n<\/p><\/div>\n
