In an <a href=\"https:\/\/drive.google.com\/file\/d\/1wrtxfvcD9FwfNfWGDL37Q6Nd8wBKXCkn\/view?usp=sharing\" target=\"_blank\" rel=\"noopener\">open letter<\/a> sent to the European Parliament, Commission, and member states on Friday, and first seen by the <a href=\"https:\/\/www.ft.com\/content\/9b72a5f4-a6d8-41aa-95b8-c75f0bc92465\" target=\"_blank\" rel=\"noopener\"><em>Financial Times<\/em><\/a>, over 150 executives from companies like Renault, Heineken, Airbus, and Siemens slammed the AI Act for its potential to \u201cjeopardise Europe\u2019s competitiveness and technological sovereignty.\u201d<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">On June 14th, the European Parliament <a href=\"https:\/\/www.theverge.com\/2023\/6\/14\/23760553\/eu-votes-in-favor-of-adopting-new-ai-regulations\" target=\"_blank\" rel=\"noopener\">greenlit<\/a> a draft of the AI Act following two years of developing its rules, and expanding them to encompass recent AI breakthroughs like large language AI models (LLMs) and foundation models, such as OpenAI\u2019s GPT-4. There are still several phases remaining before the new law can take effect, with the remaining inter-institutional negotiations expected to end later this year.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The signatories of the open letter claim that the AI Act in its current state may suppress the opportunity AI technology provides for Europe to \u201crejoin the technological avant-garde.\u201d They argue that the approved rules are too extreme, and risk undermining the bloc\u2019s technological ambitions instead of providing a suitable environment for AI innovation.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">One of the major concerns flagged by the companies involve the legislation\u2019s strict rules specifically targeting generative AI systems, a subset of AI models that typically fall under the \u201cfoundation model\u201d designation. Under the AI Act, providers of foundation AI models \u2014 regardless of their intended application \u2014 will have to register their product with the EU, undergo risk assessments, and meet transparency requirements, such as having to publicly disclose any copyrighted data used to train their models.\u00a0<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The open letter claims that the companies developing these foundation AI systems would be subject to disproportionate compliance costs and liability risks, which may encourage AI providers to withdraw from the European market entirely. \u201cEurope cannot afford to stay on the sidelines,\u201d the letter said, encouraging EU lawmakers to drop its rigid compliance obligations for generative AI models and instead focus on those that can accommodate \u201cbroad principles in a risk-based approach.\u201d\u00a0<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component clear-both block md:float-left md:mr-30 md:w-[320px] lg:-ml-100\">\n<div class=\"duet--article--article-pullquote mb-20\">\n<p class=\"duet--article--dangerously-set-cms-markup relative bg-repeating-lines-dark bg-[length:1px_1.2em] pb-8 font-polysans text-28 font-medium leading-120 tracking-1 selection:bg-franklin-20  dark:bg-repeating-lines-light dark:text-white dark:selection:bg-blurple\">\u201cThe EU AI Act, in its current form, has catastrophic implications for European competitiveness\u201d<\/p>\n<\/div>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">\u201cWe have come to the conclusion that the EU AI Act, in its current form, has catastrophic implications for European competitiveness,\u201d <a href=\"https:\/\/www.linkedin.com\/feed\/update\/urn:li:activity:7080475884272381952\/\" target=\"_blank\" rel=\"noopener\">said Jeannette zu F\u00fcrstenberg<\/a>, founding partner of La Famiglia VC, and one of the signatories on the letter. \u201cThere is a strong spirit of innovation that is being unlocked in Europe right now, with key European talent leaving US companies to develop technology in Europe. Tudorache claims that the companies who have signed the letter are reacting \u201con the stimulus of a few,\u201d and that the draft EU legislation provides \u201can industry-led process for defining standards, governance with industry at the table, and a light regulatory regime that asks for transparency. Nothing else.\u201d<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">OpenAI, the company behind ChatGPT and Dall-E, <a href=\"https:\/\/www.theverge.com\/2023\/5\/25\/23737116\/openai-ai-regulation-eu-ai-act-cease-operating\" target=\"_blank\" rel=\"noopener\">lobbied the EU<\/a> to change an earlier draft of the AI Act in 2022, requesting that lawmakers scrap a proposed amendment that would have subjected all providers of general-purpose AI systems \u2014 a vague, expansive category of AI that LLMs and foundation models can fall under \u2014 to the AI Act\u2019s toughest restrictions. The amendment was ultimately never incorporated into the approved legislation. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">OpenAI\u2019s CEO Sam Altman, who himself signed <a href=\"https:\/\/www.theverge.com\/2023\/5\/30\/23742005\/ai-risk-warning-22-word-statement-google-deepmind-openai\" target=\"_blank\" rel=\"noopener\">an open letter<\/a> warning of the potential dangers that future AI systems could pose, previously warned that the company could <a href=\"https:\/\/www.theverge.com\/2023\/5\/25\/23737116\/openai-ai-regulation-eu-ai-act-cease-operating\" target=\"_blank\" rel=\"noopener\">pull out of the European market<\/a> if it was unable to comply with EU regulations.
