Chris Rock<\/a>, as well as ongoing attention around his attempts to rebuild his public image through music, film projects and public appearances. <\/p>\nAccording to new court documents obtained by People, a judge has now ruled Will\u2019s demurrer to several counts in the complaint should be granted.<\/p>\n
The ruling stated the allegations connected to Brian\u2019s claims regarding access to his Las Vegas hotel room were not \u201cbased on sexual misconduct by Defendant Smith\u201d.<\/p>\n
\nThe judge also found Brian\u2019s belief \u201cDefendant Will Smith was involved in the decision to terminate (him) is conclusory and unsupported by any of the factual allegations\u201d outlined in the complaint.<\/p>\n
\nUnder California law, a demurrer tests whether a complaint is legally sufficient. Brian has now been granted 30 days to amend the filing.<\/p>\n
\nBrian\u2019s original complaint alleged Will had \u201cdeliberately groomed and primed\u201d him for \u201cfurther sexual exploitation\u201d after inviting him to participate in the global tour in November 2024.<\/p>\n
\nThe filing described what Brian called a \u201ctraumatic series of events\u201d during March 2025 while travelling on tour.<\/p>\n
\nHe alleged he discovered evidence that someone had entered his Las Vegas hotel room without forced entry.<\/p>\n
\nAccording to the complaint, items allegedly discovered inside the room included a handwritten note reading: \u201cBrian, I\u2019ll be back… just us,\u201d alongside a heart symbol signed \u201cStone F\u201d.<\/p>\n
\nThe complaint also referenced \u201cwipes, a beer bottle, a red backpack, a bottle of HIV medication with another individual’s name, an earring, and hospital discharge paperwork belonging to a person unbeknownst to\u201d Brian.<\/p>\n
\nBrian further alleged he \u201cfeared that an unknown individual would soon return to his room to engage in sexual acts\u201d with him.<\/p>\n
\nShortly before filing the lawsuit, Brian discussed the matter in a video shared to Instagram in December.<\/p>\n
\nHe said: \u201cI can’t get too into the details of exactly what that was because it’s already a legal issue right now, but the reason why I\u2019m speaking out about this is because getting fired or getting blamed or shamed or threatened or anything like that simply for reporting sexual misconduct or safety threats at work is not okay.\u201d<\/p>\n
\nAfter the lawsuit was filed, Will\u2019s lawyer Allen B Grodsky strongly denied the accusations in a statement.<\/p>\n
\nMr Allen said: \u201cMr. Joseph’s allegations concerning my client are false, baseless, and reckless. They are categorically denied, and we will use all legal means available to address these claims and to ensure that the truth is brought to light.\u201d<\/p>\n
