The DOD had argued that it should be able to use AI for any \u201clawful\u201d purpose and not be constrained by a private contractor.<\/p>\n<p class=\"wp-block-paragraph\">The amicus brief in support of Anthropic showed up on the docket a few hours after the Claude maker filed two lawsuits against the DOD and other federal agencies. <a href=\"https:\/\/www.wired.com\/story\/openai-deepmind-employees-file-amicus-brief-anthropic-dod-lawsuit\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Wired<\/a> was first to report the news.<\/p>\n<p class=\"wp-block-paragraph\">In the <a href=\"https:\/\/techcrunch.com\/wp-content\/uploads\/2026\/03\/anthropic-amicus-brief.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">court filing<\/a>, the Google and OpenAI employees make the point that if the Pentagon was \u201cno longer satisfied with the agreed-upon terms of its contract with Anthropic,\u201d the agency could have \u201csimply canceled the contract and purchased the services of another leading AI company.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The DOD did, in fact, sign a deal with OpenAI within moments of designating Anthropic a supply-chain risk \u2014 a move many of the ChatGPT maker\u2019s employees protested.<\/p>\n<p class=\"wp-block-paragraph\">\u201cIf allowed to proceed, this effort to punish one of the leading U.S. AI companies will undoubtedly have consequences for the United States\u2019 industrial and scientific competitiveness in the field of artificial intelligence and beyond,\u201d the brief reads. \u201cAnd it will chill open deliberation in our field about the risks and benefits of today\u2019s AI systems.\u201d<\/p>\n<div class=\"wp-block-techcrunch-inline-cta\">\n<div class=\"inline-cta__wrapper\">\n<p>Techcrunch event<\/p>\n<div class=\"inline-cta__content\">\n<p>\n\t\t\t\t\t\t\t\t\t<span class=\"inline-cta__location\">San Francisco, CA<\/span><br \/>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"inline-cta__separator\">|<\/span><br \/>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"inline-cta__date\">October 13-15, 2026<\/span>\n\t\t\t\t\t\t\t<\/p>\n<\/p><\/div>\n<\/p><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The filing also affirms that Anthropic\u2019s stated red lines are legitimate concerns warranting strong guardrails.
