The news prompted the U.K. regulator, the Information Commissioner\u2019s Office, to investigate the matter.<\/p>\n<p class=\"wp-block-paragraph\">Now, the tech giant is facing a lawsuit in the United States, as well. In the newly filed <a href=\"https:\/\/techcrunch.com\/wp-content\/uploads\/2026\/03\/Clarkson_Meta_Class_Action_Complaint-1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">complaint<\/a>, plaintiffs Gina Bartone of New Jersey and Mateo Canu of California, represented by the public interest-focused Clarkson Law Firm, allege that Meta violated privacy laws and engaged in false advertising.<\/p>\n<p class=\"wp-block-paragraph\">The complaint alleges that the Meta AI smart glasses are advertised using promises like \u201cdesigned for privacy, controlled by you,\u201d and \u201cbuilt for your privacy,\u201d which might not lead customers to assume their glasses\u2019 footage, including intimate moments, was being watched by overseas workers. The plaintiffs believed Meta\u2019s marketing and said they saw no disclaimer or information that contradicted the advertised privacy protections.<\/p>\n<p class=\"wp-block-paragraph\">The suit charges Meta and its glasses manufacturing partner Luxottica of America with conduct that violates consumer protection laws. <\/p>\n<p class=\"wp-block-paragraph\">Clarkson Law Firm, which over the years has filed other major lawsuits against tech giants, including <a href=\"https:\/\/url.usb.m.mimecastprotect.com\/s\/VdkMCP6wYwIQW7X4szfESxRH5k?domain=businessinsider.com\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Apple<\/a>,\u00a0<a href=\"https:\/\/url.usb.m.mimecastprotect.com\/s\/ndp3CQAxOxf7O5P6cPhgSG6acX?domain=cnn.com\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Google<\/a>, and\u00a0<a href=\"https:\/\/url.usb.m.mimecastprotect.com\/s\/YoB5CR8yLyhNEAWrtPi1S1L0ih?domain=washingtonpost.com\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">OpenAI<\/a>, points to the scale of the issues at hand. In 2025, over seven million people bought Meta\u2019s smart glasses. The footage from those glasses is fed into a data pipeline for review, and users can\u2019t opt out.<\/p>\n<p class=\"wp-block-paragraph\">Meta told the BBC that when people share content with Meta AI, it uses contractors to review the information to improve people\u2019s experience with the glasses, which is explained in its privacy policy, and it pointed to its \u00a0<a href=\"https:\/\/www.meta.com\/legal\/supplemental-terms-of-service\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Supplemental Meta Platforms Terms of Service<\/a>, without specifying where this was noted. One developer published an app <a href=\"https:\/\/techcrunch.com\/2026\/03\/02\/nearby-glasses-new-app-alerts-you-wearing-smart-glasses-surveillance-meta-snap-bluetooth\/\" target=\"_blank\" rel=\"noopener\">capable of detecting when smart glasses are nearby<\/a>.<\/p>\n<p class=\"wp-block-paragraph\">Meta did not have a comment on the litigation itself Thursday morning. However, spokesperson Christopher Sgro offered the following statement about the overall issue, saying, \u201cRay-Ban Meta glasses help you use AI, hands-free, to answer questions about the world around you. Unless users choose to share media they\u2019ve captured with Meta or others, that media stays on the user\u2019s device. When people share content with Meta AI, we sometimes use contractors to review this data for the purpose of improving people\u2019s experience, as many other companies do.
