Kathryn filed a motion<\/a> on October 6 \u2014 around the time that most folks were first learning of her sentence.<\/p>\nIn the motion, she essentially begged the judge to \u201creconsider\u201d her sentence.<\/p>\n
These sorts of motions are not uncommon. Believe it or not, most people behind bars would like to get out earlier.<\/p>\n
However, it seems that Kathryn\u2019s motion worked. Like, she asked to be let out early and the judge assented? <\/p>\n
Anyway, this meant that she got out of jail after only 11 days. That\u2019s not a fun week-and-a-half, but it\u2019s better than a full month. (Image Credit: Bravo)<\/span><\/figcaption><\/figure>\nHow did she manage to weasel out of her full sentence?<\/h2>\n Kathryn Dennis left the Berkeley County Hill-Finklea Detention Center in South Carolina early based upon three separate claims.<\/p>\n
Her attorney argued that \u201cthe vast majority of [DUI]\/open container cases are sentenced to pay a fine or minimal jail time.\u201d<\/p>\n
Meanwhile, Kathryn was \u201csentenced to the maximum\u201d which made her an outlier.<\/p>\n
The judge also allegedly claimed that the fallen Bravolebrity \u201cshould have been charged with felony [DUI].\u201d<\/p>\n
Kathryn\u2019s attorney argued that this was \u201cwithout \u2026 a factual basis to make such a statement.\u201d<\/p>\n (Image Credit: Bravo)<\/span><\/figcaption><\/figure>\nAdditionally, Kathryn\u2019s attorney complained that \u201c[the judge] and her child could have been on the road at the same time and location\u201d of the 2024 collision. <\/p>\n
It seems that this felt personal and emotional.<\/p>\n
Remarks like these are not entirely uncommon from judges. They will point out a personal example of how someone\u2019s irresponsible or reckless behavior put others at risk.<\/p>\n
However, Kathryn\u2019s filing griped that the judge\u2019s comments were made \u201cout of the passion of the moment rather than as a factual basis for the sentence.\u201d\u00a0<\/p>\n
Apparently, these three arguments worked. So that\u2019s going to be another financial mess for her \u2014 or, at least, a legal headache.<\/p>\n
Additionally, DUIs result in a fairly infamous series of legal hurdles and fees.<\/p>\n
We don\u2019t know when Kathryn will be back on the road. And, to be blunt, many familiar with her troubling history feel that others have a right to know.<\/p>\n
In the mean time, she can certainly avail herself of rideshare services in order to travel from place to place without doing the driving herself.<\/p>\n
If Kathryn (and others with DUI arrests) would make use of these services to begin with, they could avoid a whole mess of trouble. Also, they could avoid needlessly endangering others.<\/p>\n<\/p><\/div>\n
