It\u2019s a simple distinction.\u201d <em>The Brutalist<\/em> actually <em>would<\/em> likely be eligible under future, finalized MPSE guardrails because Respeecher is compliant with ethics initiatives and requires permission from the actor. But even then: \u201cIt is hard to know the degree to which it was used,\u201d Barber says.<\/p>\n<p class=\"paywall\">Broadly, the technology is evolving so aggressively that specific cases can\u2019t be properly evaluated. \u201c[I] can\u2019t go by a week without something popping into [my] inbox about a new generative-AI breakthrough,\u201d Barber says. \u201cThey\u2019re coming fast and furious\u2014and pretty much without regard to industry professionals or even societal implications. People need to go back to work,\u2019\u201d she said.<\/p>\n<p class=\"paywall\">This is what organizations like SAG are dealing with\u2014they\u2019re at the whim of legislation that would protect actors and others in the industry that simply doesn\u2019t exist, at least not yet. It\u2019s why the MPSE is shutting down the potential for AI in its awards until the industry has more clarity on how it can and should be used. It\u2019s why several other guilds declined to speak for this story\u2014they\u2019re in wait-and-see mode. And it\u2019s why others are choosing not to address AI, for now, in how they determine the value of their craft. \u201cIt\u2019d be a Herculean task to decide what constitutes fair use of AI and not fair use, and try to separate out those and have people report on each and every use,\u201d says <strong>Kim Davidson,<\/strong> the board chair of the Visual Effects Society. \u201cSometimes they\u2019re using tools they don\u2019t even know are powered by AI, per se.\u201d<\/p>\n<p class=\"paywall\">The VES Awards have no mandatory disclosure of the use of AI tools for submissions, only an attestation of no copyright violations. De-noising, rotoscoping, de-aging\u2014those kinds of things preceded the popularity of AI,\u201d Davidson says. \u201cBut the last thing we would want to do is cheat anyone out of fair attribution. We\u2019re not going to get any benefit out of doing that.
