{"id":162857,"date":"2025-04-17T15:03:11","date_gmt":"2025-04-17T15:03:11","guid":{"rendered":"https:\/\/entertainment.runfyers.com\/index.php\/2025\/04\/17\/judge-rules-google-illegally-monopolized-adtech-opening-door-to-potential-breakup-techcrunch\/"},"modified":"2025-04-17T15:03:11","modified_gmt":"2025-04-17T15:03:11","slug":"judge-rules-google-illegally-monopolized-adtech-opening-door-to-potential-breakup-techcrunch","status":"publish","type":"post","link":"https:\/\/entertainment.runfyers.com\/index.php\/2025\/04\/17\/judge-rules-google-illegally-monopolized-adtech-opening-door-to-potential-breakup-techcrunch\/","title":{"rendered":"Judge rules Google illegally monopolized adtech, opening door to potential breakup\u00a0 | TechCrunch"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p id=\"speakable-summary\" class=\"wp-block-paragraph\">A federal judge has <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.vaed.533508\/gov.uscourts.vaed.533508.1410.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">found<\/a> that Google violated antitrust laws by \u201cwillfully acquiring and maintaining monopoly power\u201d in the advertising technology market, rounding out a two-year saga after the U.S. and eight states filed its <a href=\"https:\/\/techcrunch.com\/2023\/01\/24\/u-s-officially-sues-google-claiming-it-has-a-digital-ad-monopoly\/\" target=\"_blank\" rel=\"noreferrer noopener\">initial complaints<\/a> against the Alphabet-owned company.<\/p>\n<p class=\"wp-block-paragraph\">The court will set a briefing schedule and hearing date to determine appropriate remedies for the antitrust violations, per a Thursday filing.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">The remedies could include forcing Google to break up its advertising business, like selling its Google Ad Manager, which includes the AdX ad exchange and DFP (DoubleClick for Publishers), the ad server used for publishers.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">Or the courts could force behavioral remedies that would allow Google to keep its business intact, but would impose restrictions to ensure fair competition, like prohibiting Google from prioritizing its own exchange or demand in auctions.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">In a separate antitrust case, another federal judge last year found that <a href=\"https:\/\/techcrunch.com\/2024\/08\/05\/google-loses-massive-antitrust-case-over-search\/\" target=\"_blank\" rel=\"noreferrer noopener\">Google illegally monopolized the general internet search market<\/a>. The judge has not yet issued remedies on that case, but is expected to do so in mid-2025.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">In the adtech case, Judge Leonie M. Brinkema wrote in her memorandum opinion that the plaintiffs failed to prove that the \u201copen-web display advertiser ad networks\u201d are a relevant market where Google has monopoly power. These networks help advertisers buy display ads across the open web, so they\u2019re outside of closed ecosystems like Facebook, Instagram, and Google Search.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">The\u00a0judge did agree that Google violated the Sherman Act by monopolizing and unlawfully tying two parts of the adtech stack together, specifically DFP and AdX, and that Google is guilty of abuse of monopoly power in the publisher-side adtech.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">\u201cWe won half of this case and we will appeal the other half,\u201d Lee-Anne Mulholland, Google\u2019s vice president of regulatory affairs, said in an emailed statement. \u201cThe Court found that our advertiser tools and our acquisitions, such as DoubleClick, don\u2019t harm competition. We disagree with the Court\u2019s decision regarding our publisher tools. Publishers have many options and they choose Google because our ad tech tools are simple, affordable and effective.\u201d\u00a0<\/p>\n<p class=\"wp-block-paragraph\">The Department of Justice \u2013 alongside California, Colorado, Connecticut, New Jersey, New York, Rhode Island, Tennessee, and Virginia \u2013 filed suit against Google\u2019s alleged use of monopoly power over the digital ad market <a href=\"https:\/\/techcrunch.com\/2023\/01\/24\/u-s-officially-sues-google-claiming-it-has-a-digital-ad-monopoly\/\" target=\"_blank\" rel=\"noopener\">in January 2023<\/a>.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">The DOJ argued that Google achieved its monopoly through anti-competitive conduct when it purchased DoubleClick in 2008, which then became the backbone of its ad business. Google then bought AdMeld in 2011 to gain more control over the ad market\u2019s supply side.
