Kellie Pickler<\/strong><\/a>\u2019s ongoing legal battle<\/a> with her late husband Kyle Jacobs<\/strong>\u2019 parents could get \u201ccomplicated,\u201d according to a legal expert.<\/p>\n

\u201cProbate cases can be very difficult for all involved. What should otherwise be intimate family matters are made public in a court of law,\u201d Tennessee-based attorney and estate planner Michael Crowder<\/strong>, who has no connection to the case, exclusively told Us Weekly. <\/i>\u201cConflict can be compounded by the pain, hurt and sometimes guilt or anger that the family is experiencing over the loss of a loved one.\u201d<\/p>\n

Jacobs died by suicide<\/a> in February 2023 at the age of 49. Nearly one year later, Jacobs\u2019 parents, Reed and Sharon, allegedly asked Pickler, 38, for many of Jacobs\u2019 personal belongings. (Reed and Sharon are coadministrators of Jacobs\u2019 estate.)<\/p>\n

Pickler, meanwhile, claimed that she did not have any of the items \u2014 Jacobs\u2019 gun collection, watches, jewelry, musical instruments and more \u2014 in her possession. She filed court documents in 2024, claiming that Reed and Sharon also removed certain items from her home without her knowledge or consent. Reed and Sharon disputed Pickler\u2019s accusations in a November 2024 legal response, asserting that they had an \u201cexpress invitation\u201d to collect Jacobs\u2019 belongings.<\/p>\n

\n\t\t\tOne year after Kellie Pickler\u2019s husband, Kyle Jacobs, died by suicide, the country star is involved in a legal battle with his parents. \u201cA dispute has arisen amongst the parties regarding certain personal property allegedly [Kyle\u2019s] possession prior to his death,\u201d court documents filed in August 2024 and later obtained by Us Weekly read. Pickler [\u2026]\t\t<\/p>\n<\/div>\n

\u201cThe dispute in this case involves the ownership and division of tangible personal property,\u201d Crowder explained to Us.<\/i> \u201cSome of the most contentious cases I\u2019ve handled in my career involve the division of a person\u2019s belongings \u2014 what we lawyers call \u2018tangible personal property,\u2019 such as furniture, jewelry, guns, musical instruments, etc. These disputes are most often fueled not by the monetary value of the items, but by their sentimental value.\u201d<\/p>\n

According to Crowder, such disputes can often become \u201cproxy wars\u201d for family members to \u201cwork out long-standing issues\u201d that started long before an individual\u2019s death.<\/p>\n

\u201cOne of the threshold issues in this case appears to be whether certain items of tangible personal property were owned by Ms. Pickler or by her husband,\u201d Crowder said. \u201cMs. Pickler has alleged that the Jacobses entered her and her husband\u2019s home and took possession of certain items. If those items were, in fact, owned by Ms. Pickler, the Jacobses had no authority to take possession of them and acted improperly in doing so.\u201d<\/p>\n

Crowder, however, acknowledged that Reed and Sharon are \u201cauthorized under Tennessee law\u201d to take possession of Jacobs\u2019 tangible personal property since they are his estate administrators.<\/p>\n

\u201cDetermining ownership of such property can be complicated. It may involve tracing the source of the funds used to purchase the items,\u201d Crowder added to Us. <\/i>\u201cFor example, did the money come from Ms. Pickler\u2019s employment, or from her husband\u2019s? Additionally, spouses can enter into contracts regarding the ownership of their property, often through prenuptial or postnuptial agreements.\u201d<\/p>\n

Pickler and Jacobs did sign a prenup when they got married in 2011, which Reed and Sharon have used as a reason why the singer\u2019s legal request should not be granted.<\/p>\n

\n\t\t\tKellie Pickler and husband Kyle Jacobs bonded over their musical backgrounds \u2014 but they chose to take their time before getting hitched. The American Idol alum met her future husband in the mid-2000s through a mutual friend. While playing Us Weekly\u2019s \u201cNewlywed Game\u201d in December 2015, the couple both recalled Jacobs\u2019 pickup line as, \u201cHi, [\u2026]\t\t<\/p>\n<\/div>\n

\u201cThe court will likely need to interpret that contract to determine what the parties agreed to in terms of ownership,\u201d Crowder said. \u201cTo the extent the court determines that some or all of the property was owned by Ms. Pickler\u2019s husband, the Jacobses have the right to collect that property as the estate\u2019s administrators. Some or all of that property could be sold during the administration of the estate, if necessary, to pay debts and expenses.\u201d<\/p>\n

Once any debts and expenses are paid, it is up to an administrator to distribute the remaining property to the estate\u2019s heirs. Since Pickler and Jacobs did not have children, Tennessee law typically allocates the entire estate to the individual\u2019s spouse.<\/p>\n

\u201cUnder the default rules, Ms. Pickler would be entitled to all of her husband\u2019s property after the estate is administered by the Jacobses. However, a spouse\u2019s right to inherit can be modified by contract,\u201d Crowder told Us<\/i>. \u201cMany people think a prenuptial agreement only addresses property division in a divorce, but it can also address the spouses\u2019 rights to each other\u2019s estate upon death. Additionally, it\u2019s possible for the family of a deceased person to reach an agreement amongst themselves regarding the division of property.\u201d<\/p>\n
