The documents contain private declarations from three DHS officers who had reviewed Harry\u2019s records, as well as the transcript of a hearing with Judge <strong>Carl Nichols<\/strong> about the matter. However, they redact all details about the Duke of Sussex\u2019s immigration status and the type of visa he has, with one of the DHS officials stating there was no evidence that Harry received special treatment from the government.<\/p>\n<p>A source close to the duke says the documents show he was properly admitted to the US. \u201cAllegations that Prince Harry received preferential treatment during his US immigration process were unequivocally dismissed today by the Trump administration,\u201d the source tells <em>Vanity Fair.<\/em> \u201dFurthermore, the redactions in the case further weaken the Heritage Foundation\u2019s claim that the duke\u2019s immigration records should be considered a matter of public interest.\u201d<\/p>\n<p class=\"paywall\">The Heritage Foundation, the conservative think tank behind <a href=\"https:\/\/www.vanityfair.com\/news\/story\/project-2025-donald-trump\" target=\"_blank\" rel=\"noopener\">the controversial Project 2025 plans<\/a> that have helped guide President <strong>Donald Trump<\/strong>\u2019s second term, started its quest to acquire Harry\u2019s immigration information in 2023, soon after the publication of his best-selling memoir, <em>Spare.<\/em> Their early filings in the case claim that Harry admitted to \u201ca long history\u201d of drug use in the memoir, alleging that this raised questions about whether the royal was properly vetted when he moved to the US in 2020 along with his wife, <strong>Meghan Markle.<\/strong>\u00a0<\/p>\n<p class=\"paywall\"><strong>Nile Gardiner,<\/strong> director of the Heritage Foundation\u2019s Margaret Thatcher Center for Freedom, told <a data-offer-url=\"https:\/\/www.gbnews.com\/royal\/royal-news-heritage-foundation-prince-harry-visa\" class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.gbnews.com\/royal\/royal-news-heritage-foundation-prince-harry-visa&quot;}\" href=\"https:\/\/www.gbnews.com\/royal\/royal-news-heritage-foundation-prince-harry-visa\" rel=\"nofollow noopener\" target=\"_blank\">GB News<\/a> that he was not surprised that Harry\u2019s full application was not released. \u201cWe still do not know whether or not Prince Harry lied on his application,\u201d Gardiner added. \u201cThe fight continues to release Prince Harry\u2019s immigration application to the American people.\u201d<\/p>\n<p class=\"paywall\">In a heavily redacted <a href=\"https:\/\/dn721603.ca.archive.org\/0\/items\/gov.uscourts.dcd.254744\/gov.uscourts.dcd.254744.61.1.pdf\" target=\"_blank\" rel=\"noopener\">declaration<\/a> from April 2024 released on Tuesday, <strong>Jarrod Panter,<\/strong> a DHS official in the Freedom of Information and Privacy Act Unit, told the court that Heritage\u2019s arguments about \u201cpreferential treatment\u201d were baseless, adding that \u201capplicable rules and regulations\u201d were followed when Harry was admitted to the US. \u201cThis speculation by Plaintiffs does not point to any evidence of government misconduct. The records, as explained above, do not support such an allegation but show the regulatory process involved in reviewing and granting immigration benefits, which was done in compliance with the Immigration and Nationality Act.\u201d<\/p>\n<p class=\"paywall\">The case was originally dismissed <a data-offer-url=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/prince-harry-visa-case-meghan-markle-b2357920.html\" class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.independent.co.uk\/news\/world\/americas\/prince-harry-visa-case-meghan-markle-b2357920.html&quot;}\" href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/prince-harry-visa-case-meghan-markle-b2357920.html\" rel=\"nofollow noopener\" target=\"_blank\">last fall<\/a>, following DHS\u2019s decision that none of the records could be made public without compromising Harry\u2019s right to privacy. The foundation later appealed the decision, arguing that certain aspects of DHS\u2019s private decision-making should be released. In a February hearing, the first in the case since <strong>Donald Trump<\/strong>\u2019s reelection, Judge Nichols indicated that some documents could be made public provided that they didn\u2019t violate Harry\u2019s privacy rights.<\/p>\n<p class=\"paywall\">According to a transcript of an April 30, 2024, hearing that took place in front of Nichols, DHS attorneys <strong>John Bardo<\/strong> and <strong>Peter Pfaffenroth<\/strong> <a data-offer-url=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.254744\/gov.uscourts.dcd.254744.61.6.pdf\" class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.254744\/gov.uscourts.dcd.254744.61.6.pdf&quot;}\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.254744\/gov.uscourts.dcd.254744.61.6.pdf\" rel=\"nofollow noopener\" target=\"_blank\">noted<\/a> that part of Harry\u2019s immigration records were in the possession of the State Department. \u201cWe would have to research whether the court is able to get another agency that\u2019s not involved in this case into this case, and we would likely need to take it up the chain through various people at State and at Justice,\u201d Bardo said. \u201cBut this case is really about whether the Heritage Foundation is entitled to these records.\u201d<\/p>\n<p class=\"paywall\">In February, Trump told the <em><a data-offer-url=\"https:\/\/nypost.com\/2025\/02\/08\/us-news\/trump-rules-out-deporting-prince-harry-takes-jab-at-meghan-markle\/\" class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/nypost.com\/2025\/02\/08\/us-news\/trump-rules-out-deporting-prince-harry-takes-jab-at-meghan-markle\/&quot;}\" href=\"https:\/\/nypost.com\/2025\/02\/08\/us-news\/trump-rules-out-deporting-prince-harry-takes-jab-at-meghan-markle\/\" rel=\"nofollow noopener\" target=\"_blank\">New York Post<\/a><\/em> that he had no plans to deport Harry from American soil, despite the Heritage Foundation\u2019s efforts. Still, the invocation of the State Department might set the conservative think tank on another route by which they can continue to pursue Harry\u2019s private immigration records.
