Conlon told the outlet that guards approached her while she was in the building\u2019s lobby and said she wasn\u2019t allowed to be there because of her connection to a legal case against the company that owns the hall. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 -tracking-1 leading-160 dark:text-white selection:bg-franklin-20 dark:selection:bg-blurple [&amp;_a]:shadow-underline-black [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple dark:[&amp;_a]:shadow-underline-white\">\u201cI believe they said that our recognition picked you up,\u201d she told NBC, saying that she was asked to identify herself and that \u201cthey knew my name before I told them. However, it does make it clear that it uses the tech. \u201cWe have always made it clear to our guests and to the public that we use facial recognition as one of our tools to provide a safe and secure environment and we will continue to use it to protect against the entry of individuals who we have prohibited from entering our venues,\u201d the company said in a statement sent to <em>The Verge<\/em> by Mikyl Cordova, a spokesperson for the company.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 -tracking-1 leading-160 dark:text-white selection:bg-franklin-20 dark:selection:bg-blurple [&amp;_a]:shadow-underline-black [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple dark:[&amp;_a]:shadow-underline-white\">MSG refused to provide details about its system, such as whose facial recognition tech it uses. There are <a href=\"https:\/\/www.vice.com\/en\/article\/pkygg7\/we-asked-43-facial-recognition-companies-if-theyll-refuse-to-work-with-cops\" target=\"_blank\" rel=\"noopener\">many companies that develop these kinds of systems<\/a>, with some selling them to businesses and governments. However, the company has a long history with facial recognition systems \u2014 it was testing them by early 2018, according to <a href=\"https:\/\/www.nytimes.com\/2018\/03\/13\/sports\/facial-recognition-madison-square-garden.html\" target=\"_blank\" rel=\"noopener\">a report from <em>The New York Times<\/em><\/a>. As NBC shows in its report, the company has signage posted at the venue to tell people that security uses facial recognition, as it\u2019s <a href=\"https:\/\/techcrunch.com\/2021\/07\/09\/new-york-city-biometrics-law\/\" target=\"_blank\" rel=\"noopener\">legally required to do<\/a>.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 -tracking-1 leading-160 dark:text-white selection:bg-franklin-20 dark:selection:bg-blurple [&amp;_a]:shadow-underline-black [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple dark:[&amp;_a]:shadow-underline-white\">It\u2019s possible there are other ways Conlon could have identified before the show; if she\u2019d been asked to present her identification or tickets with her name on them at any point, it would\u2019ve been an opportunity for other security systems to flag her. But she told NBC that she was picked out pretty much as soon as she went through the metal detector.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 -tracking-1 leading-160 dark:text-white selection:bg-franklin-20 dark:selection:bg-blurple [&amp;_a]:shadow-underline-black [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple dark:[&amp;_a]:shadow-underline-white\">The incident stems from the fact that Conlon is a lawyer at a firm that\u2019s involved in a lawsuit against MSG. While she told NBC that she hasn\u2019t worked on the case, MSG\u2019s policy \u201cprecludes attorneys from firms pursuing active litigation against the company from attending events at our venues until that litigation has been resolved,\u201d according to Cordova. When lawyers from another case brought it up, Judge Kathaleen McCormick \u2014 who presided over two different Elon Musk cases this year as he <a href=\"https:\/\/www.theverge.com\/23026874\/elon-musk-twitter-buyout-news-updates\" target=\"_blank\" rel=\"noopener\">tried to get out out of buying Twitter<\/a> and argued over his pay package with <a href=\"https:\/\/www.theverge.com\/2022\/11\/14\/23458254\/elon-musk-tesla-trial-pay-shareholder-autopilot-crash\" target=\"_blank\" rel=\"noopener\">Tesla shareholders<\/a> \u2014 called it \u201cthe stupidest thing I\u2019ve ever read,\u201d according to <a href=\"https:\/\/www.reuters.com\/legal\/legalindustry\/madison-square-garden-doubles-down-plaintiffs-lawyer-ban-even-after-it-backfires-2022-11-15\/\" target=\"_blank\" rel=\"noopener\">documents obtained by <em>Reuters<\/em><\/a>.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 -tracking-1 leading-160 dark:text-white selection:bg-franklin-20 dark:selection:bg-blurple [&amp;_a]:shadow-underline-black [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple dark:[&amp;_a]:shadow-underline-white\">Another judge in a separate case ruled that \u201cplaintiffs may not be denied entry into any shows where they possess a valid ticket\u201d while noting that MSG did have the right not to sell them tickets in the first place. The company didn\u2019t answer <em>The Verge<\/em>\u2019s questions about whether it had systems in place that would\u2019ve prevented Conlon from purchasing a ticket, either through its systems or from resellers.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 -tracking-1 leading-160 dark:text-white selection:bg-franklin-20 dark:selection:bg-blurple [&amp;_a]:shadow-underline-black [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple dark:[&amp;_a]:shadow-underline-white\">Despite the ruling, MSG sent another letter to law firms saying that they weren\u2019t allowed onto its premises and that it could revoke their tickets, according to <em>Reuters<\/em>. It seems likely that the question of whether MSG\u2019s ban is allowed will be litigated in many courtrooms over the next who knows how long. That probably won\u2019t be the case for its use of facial recognition itself \u2014 in New York, it\u2019s legal for businesses to do so, and <a href=\"https:\/\/www.theverge.com\/2022\/12\/8\/23496852\/microsoft-dhs-surveillance-data-fusion\" target=\"_blank\" rel=\"noopener\">reports have shown<\/a> that the NYC government has received millions in funding for its own surveillance systems. (It has curtailed facial recognition in at least a few instances, though; schools <a href=\"https:\/\/www.nyclu.org\/en\/news\/ny-ignoring-ban-facial-recognition-schools\" target=\"_blank\" rel=\"noopener\">currently aren\u2019t supposed to use it<\/a>.)<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 -tracking-1 leading-160 dark:text-white selection:bg-franklin-20 dark:selection:bg-blurple [&amp;_a]:shadow-underline-black [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple dark:[&amp;_a]:shadow-underline-white\">Even as they <a href=\"https:\/\/www.theverge.com\/2021\/7\/14\/22576236\/retail-stores-facial-recognition-civil-rights-organizations-ban\" target=\"_blank\" rel=\"noopener\">become<\/a> <a href=\"https:\/\/www.theverge.com\/2022\/1\/26\/22903437\/id-me-facial-recognition-databases-irs-match\" target=\"_blank\" rel=\"noopener\">more<\/a> <a href=\"https:\/\/www.theverge.com\/2021\/8\/25\/22641216\/facial-recognition-gao-report-agency-dhs-cbp-fbi\" target=\"_blank\" rel=\"noopener\">commonplace<\/a>, facial recognition systems aren\u2019t accepted everywhere. While their ability to scan a large number of people quickly and attempt to match faces to an identity in a database makes them attractive to governments and businesses, there are members of the public and <a href=\"https:\/\/www.theverge.com\/2021\/1\/25\/22248849\/new-york-city-facial-recognition-ban-amnesty-international-nypd\" target=\"_blank\" rel=\"noopener\">privacy advocates<\/a> that have pushed back against their use. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 -tracking-1 leading-160 dark:text-white selection:bg-franklin-20 dark:selection:bg-blurple [&amp;_a]:shadow-underline-black [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple dark:[&amp;_a]:shadow-underline-white\">Outside of the concerns around how they can be used to intensify policing or track people\u2019s movements, facial recognition opponents often point to studies suggesting that many of the systems are less accurate when identifying people who aren\u2019t white.
