Carpenter doesn\u2019t face criminal charges, but the state is seeking up to a $250,000 fine.\u00a0<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">This is the first time Texas has sued an out-of-state doctor for providing abortion services to a Texas patient via telemedicine. Notably, New York, where Carpenter is based, has a <a href=\"https:\/\/www.nysenate.gov\/newsroom\/articles\/2023\/shelley-b-mayer\/new-york-times-new-york-passes-bill-shield-abortion\" target=\"_blank\" rel=\"noopener\">\u201cshield law\u201d<\/a> that\u2019s designed to protect doctors who prescribe and send abortion pills to patients in other states, including those that, like Texas, have outlawed abortion.\u00a0<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">\u201cRegardless of what the courts in Texas do, the real question is whether the courts in New York recognize it,\u201d Greer Donley, a professor at the University of Pittsburgh School of Law, <a href=\"https:\/\/www.texastribune.org\/2024\/12\/13\/texas-paxton-abortion-pill-mail-lawsuit\/\" target=\"_blank\" rel=\"noopener\">told the <em>Texas Tribune<\/em><\/a>.\u00a0<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">According to the <a href=\"https:\/\/www.texasattorneygeneral.gov\/sites\/default\/files\/images\/press\/Dr%20Carpenter%20Filed%20Petition.pdf\" target=\"_blank\" rel=\"noopener\">complaint<\/a>, a 20-year-old woman who became pregnant sometime in mid-May was prescribed mifepristone and misoprostol by Carpenter at an undisclosed time. The woman, who is not named in the lawsuit, experienced adverse side effects from the pills and asked her partner to take her to the hospital because of hemorrhage or severe bleeding on July 16th.\u00a0<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">At the hospital, the woman\u2019s partner was told that she \u201c\u2018had been\u2019 nine weeks pregnant before losing the child,\u201d the complaint says, which made him conclude that she \u201chad intentionally withheld information from him regarding her pregnancy, and he further suspected\u201d that the woman \u201chad in fact done something to contribute to the miscarriage or abortion\u201d of the pregnancy. According to the complaint, she had not previously told her partner she was pregnant. The state has a near-total ban on abortion at all stages of pregnancy, with narrow exceptions if the life of the mother is at risk but no exceptions for cases of rape and incest.
