Google<\/em><\/a>, ordering Google to effectively open up the Google Play app store to competition for three whole years. Google will have to distribute rival third-party app stores<em> within <\/em>Google Play, and it must give rival third-party app stores access to the full catalog of Google Play apps, unless developers opt out individually. The injunction says that Google can \u201ctake reasonable measures\u201d that are \u201cstrictly necessary and narrowly tailored\u201d and are \u201ccomparable\u201d to how it currently polices the Google Play Store. Google will be able to charge a fee for that policing, too. The game developer <a href=\"https:\/\/www.theverge.com\/2020\/8\/14\/21368651\/apple-fortnite-ios-app-store-ban-lawsuit-epic-games-payments\" target=\"_blank\" rel=\"noopener\">sprung a premeditated trap<\/a> on both tech giants by attempting to bypass their 30 percent fee on in-app purchases with a surprise update to its mega-popular game <em>Fortnite. <\/em>Both tech companies retaliated by kicking <em>Fortnite<\/em> off their app stores, only to be met by a coordinated #FreeFortnite action campaign and a pair of lawsuits accusing each of creating illegal monopolies.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The Apple case is already over, and Apple mostly won: the <a href=\"https:\/\/www.theverge.com\/2024\/1\/16\/24039983\/supreme-court-epic-apple-antitrust-case-rejected\" target=\"_blank\" rel=\"noopener\">Supreme Court rejected Epic\u2019s final appeal<\/a> this January. The only thing Epic legally achieved there was an order dismantling Apple\u2019s \u201canti-steering rules,\u201d theoretically letting developers freely tell their customers how to bypass Apple\u2019s payment systems. (I won\u2019t discuss the Apple case more than this brief outline since I\u2019m\u00a0<a href=\"http:\/\/www.theverge.com\/authors\/sean-hollister\/archives\/38#:~:text=Ethics%20statement%2C%20June%202023%3A\" target=\"_blank\" rel=\"noopener\">ethically bound<\/a>.)<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">But the Google case took far longer to kick off, and it went very differently. I spent 15 days reporting live from the courtroom, and <a href=\"https:\/\/www.theverge.com\/23959932\/epic-v-google-trial-antitrust-play-store-fortnite-recap\" target=\"_blank\" rel=\"noopener\">I saw Epic show time and again<\/a> that Google was running scared, didn\u2019t treat developers equally, and had something to hide. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The jury in <em>Epic v. Google<\/em> was thoroughly convinced: last December, <a href=\"https:\/\/www.theverge.com\/23994174\/epic-google-trial-jury-verdict-monopoly-google-play\" target=\"_blank\" rel=\"noopener\">it reached the unanimous verdict<\/a> that the Google Play app store and Google Play Billing service were an illegal monopoly and that many of the special deals it made with game developers and phone manufacturers were anticompetitive behavior.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">In August, <a href=\"https:\/\/www.theverge.com\/2024\/8\/14\/24220491\/epic-google-android-app-store-monopoly-remedies-hearing\" target=\"_blank\" rel=\"noopener\">Judge Donato warned<\/a> that Google would pay for its behavior. \u201cWe\u2019re going to tear the barriers down, it\u2019s just the way it\u2019s going to happen,\u201d he said. In remedy hearings, he rejected Google\u2019s suggestions that meeting Epic\u2019s demands would take too much work, cost too much money, or were impossible to arrange without taking substantial time.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">It\u2019s not yet clear whether Google will have to immediately follow the court\u2019s demands. Google has already promised to appeal the verdict \u2014 and like Apple, Google will likely ask that appeals court to press pause on Judge Donato\u2019s order while it tries its luck again. Apple spent years <a href=\"https:\/\/www.theverge.com\/2023\/8\/9\/23826043\/epic-apple-app-store-supreme-court-petition\" target=\"_blank\" rel=\"noopener\">delaying the anti-steering rules change<\/a> with its legal appeals.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\"><a href=\"https:\/\/www.theverge.com\/policy\/2024\/9\/30\/24256395\/epic-sues-google-samsung-antitrust-auto-blocker\" target=\"_blank\" rel=\"noopener\">Epic filed a second lawsuit against Google (and Samsung)<\/a> one week ago, arguing the companies were already attempting to sidestep this upcoming injunction by adding additional friction for third party app stores.
