{"id":127088,"date":"2024-09-23T22:16:13","date_gmt":"2024-09-23T22:16:13","guid":{"rendered":"https:\/\/entertainment.runfyers.com\/index.php\/2024\/09\/23\/how-the-menendez-brothers-therapist-and-his-mistress-became-the-murder-trials-circus-sideshow\/"},"modified":"2024-09-23T22:16:13","modified_gmt":"2024-09-23T22:16:13","slug":"how-the-menendez-brothers-therapist-and-his-mistress-became-the-murder-trials-circus-sideshow","status":"publish","type":"post","link":"https:\/\/entertainment.runfyers.com\/index.php\/2024\/09\/23\/how-the-menendez-brothers-therapist-and-his-mistress-became-the-murder-trials-circus-sideshow\/","title":{"rendered":"How the Menendez Brothers\u2019 Therapist and His Mistress Became the Murder Trial\u2019s Circus Sideshow"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>As <strong>Ryan Murphy<\/strong>\u2019s <a href=\"https:\/\/www.vanityfair.com\/hollywood\/story\/the-wild-true-tale-behind-monsters-the-lyle-and-erik-menendez-story\" target=\"_blank\" rel=\"noopener\"><em>Monsters: The Lyle and Erik Menendez Story<\/em><\/a> recalls in its controversial, true-crime-camp glory, the tale of Beverly Hills brothers <strong>Lyle<\/strong> and <strong>Erik<\/strong> brutally murdering their parents, Jos\u00e9 and Mary Louise \u201cKitty\u201d Menendez, in 1989 was an American horror story. It had all the elements to transfix a nation\u2014spoiled, attractive Beverly Hills brothers who made some seriously bone-headed decisions (one wrote a screenplay about a character who kills his parents; both spent up to a combined $700,000 in the aftermath of their parents\u2019 deaths) and allegations of sexual abuse in the country\u2019s most elite zip code. While those pulpy issues were at the forefront of the boys\u2019 <a href=\"https:\/\/archive.vanityfair.com\/article\/1993\/10\/dominick-dunnes-courtroom-notebook-the-menendez-murder-trial\" target=\"_blank\" rel=\"noopener\">1993 trial<\/a>, the court case also featured two witnesses whose behavior was perhaps just as confounding (though not criminal): Menendez therapist <strong>L. Jerome Oziel<\/strong> and his mistress, <strong>Judalon Smyth.<\/strong> Eventually, these two managed to temporarily steal the courtroom spotlight from Lyle and Erik. In fact, their testimony became such a circus sideshow that neither was invited back to testify during the brothers\u2019 second trial.<\/p>\n<p>Dominick Dunne, who covered the trial for this magazine, credited Erik\u2019s lead defense counsel <strong>Leslie Abramson<\/strong> for taking \u201cwhat was virtually an open-and-shut case of premeditated murder in the first degree,\u201d complete with confession from the killers, and shapeshifting it before the public\u2019s very eyes. Oziel was the source of the case\u2019s smoking-gun evidence: tapes of the brothers\u2019 therapy sessions, during which they <a data-offer-url=\"https:\/\/www.upi.com\/Archives\/1995\/10\/13\/Jury-hears-Lyle-Menendez-on-tape\/9945813556800\/\" class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.upi.com\/Archives\/1995\/10\/13\/Jury-hears-Lyle-Menendez-on-tape\/9945813556800\/&quot;}\" href=\"https:\/\/www.upi.com\/Archives\/1995\/10\/13\/Jury-hears-Lyle-Menendez-on-tape\/9945813556800\/\" rel=\"nofollow noopener\" target=\"_blank\">described plotting<\/a> their parents\u2019 murders (\u201cthe perfect crime,\u201d they called it, as Oziel remembered). Abramson fought for the tapes to be excluded from trial. When she lost that battle, she <a href=\"https:\/\/www.latimes.com\/archives\/la-xpm-1993-08-09-mn-22024-story.html\" target=\"_blank\" rel=\"noopener\">announced<\/a> that she would discredit the psychologist in \u201cevery way known to man and God.\u201d<\/p>\n<p class=\"paywall\">During the trial, Abramson worked Oziel like a chew toy. She <a href=\"https:\/\/www.latimes.com\/archives\/la-xpm-1993-08-09-mn-22024-story.html\" target=\"_blank\" rel=\"noopener\">got him<\/a> to admit he hadn\u2019t told the Menendez family\u2014who hired him after the boys were caught burglarizing two homes\u2014that his license was on probation by the state board of psychology because of what it called an inappropriate \u201cdual relationship\u201d: exchanging therapy for construction work done at his house by a patient. Abramson <a href=\"https:\/\/www.latimes.com\/archives\/la-xpm-1993-08-09-mn-22024-story.html\" target=\"_blank\" rel=\"noopener\">asked<\/a> about a 1990 lawsuit Smyth filed against Oziel in Los Angeles Superior Court, alleging that the psychologist assaulted, raped, kidnapped, and medicated her. When Abramson asked whether Oziel settled the case for $400,000 to $500,000, he replied that his insurance company did. (Oziel had also filed a countersuit, alleging that Smyth developed a \u201cbizarre fixation and obsession with him.\u201d)<\/p>\n<p class=\"paywall\">At the time, the state psychology board was <a href=\"https:\/\/www.latimes.com\/archives\/la-xpm-1993-08-09-mn-22024-story.html\" target=\"_blank\" rel=\"noopener\">accusing<\/a> Oziel of engaging in a sexual relationship with another woman who worked in his home as a housekeeper\u2014and said that he improperly gave her medication and assaulted her. (Oziel denied those charges.) It was also revealed during trial that Oziel didn\u2019t turn his Menendez session tapes into authorities. Instead, he put the tapes into a safe deposit box and, according to Smyth, tried to extort money from the brothers by saying that paying him weekly, even if they did not attend sessions, would be good for their defense if they were ever put on trial. By the end of Abramson\u2019s days-long skewering, even she was bored, according to <strong>Robert Rand<\/strong>\u2019s book <em>The Menendez Murders.<\/em> The lawyer told the judge that, during her questioning of Oziel the following day, \u201cI\u2019m going to be briefer than I thought. Jerome Oziel testifying.<\/p>\n<p><\/span><span class=\"BaseWrap-sc-gjQpdd BaseText-ewhhUZ CaptionCredit-ejegDm iUEiRd cvffOM fNaHcW caption__credit\">Nick Ut\/AP.<\/span><\/div>\n<\/figure>\n<\/div>\n<p class=\"paywall\">Oziel\u2019s testimony was so damaging to his character that, in 1993 the <em>LA Times<\/em> <a href=\"https:\/\/www.latimes.com\/archives\/la-xpm-1993-08-09-mn-22024-story.html\" target=\"_blank\" rel=\"noopener\">reported<\/a> that his cushy existence\u2014he had a 6,000-square-foot canyon home, a psychologist wife, two children, and a waiting list for his $150-per-hour sessions\u2014is \u201cnot such a good life anymore\u2026. For Oziel, it is his reputation that is on trial.\u201d He faced state disciplinary hearings due to the revelations in court. In 1997, the Consumer Affairs Board of Psychology charged Oziel with \u201ca variety of offenses,\u201d according to a <a href=\"http:\/\/www.cnn.com\/US\/9701\/03\/menendez.psychologist\/index.html\" target=\"_blank\" rel=\"noopener\">spokesperson<\/a> who spoke to CNN, including sharing confidential information about his patients with Smyth; having both a business and sexual relationship with Smyth; supplying her with drugs; physically assaulting her on two occasions; and engaging in sexual misconduct with two female clients. (Oziel\u2019s attorney denied the last charge, claiming the women were not patients.) Rather than go to court, Oziel surrendered his license \u201cwhile at the same time denying he engaged in any improprieties,\u201d <a href=\"http:\/\/www.cnn.com\/US\/9701\/03\/menendez.psychologist\/index.html\" target=\"_blank\" rel=\"noopener\">according<\/a> to his lawyer. \u201cHe is not practicing psychology anymore and hasn\u2019t been for several years. It wasn\u2019t worth the expense and interference with his life.\u201d<\/p>\n<p class=\"paywall\">The defense\u2019s greatest gift, during the first trial, may have been Oziel\u2019s mistress: an attractive woman who first reached out to Oziel in the hopes of getting relationship therapy. After she realized she could not afford Oziel\u2019s sessions, she became sexually involved with the psychologist, and dysfunctionally enmeshed in both his marriage and the Menendez case.
