Miley Cyrus<\/strong><\/a> is facing a lawsuit.<\/p>\n The suit claims she and co-songwriters Gregory Hein<\/strong> and Michael Pollack <\/strong>copied portions of a Bruno Mars<\/strong><\/a> single when they wrote her Grammy-winning smash \u201cFlowers,\u201d via Rolling Stone<\/a>.<\/p>\n The lawsuit was filed Monday (September 16) in Los Angeles by Tempo Music Investments, which claims \u201cFlowers\u201d includes unauthorized \u201cexploitation\u201d of several elements of the 2013 Bruno Mars<\/strong> hit, \u201cWhen I Was Your Man.\u201d The suit also names Sony Music Publishing, Apple, Target, Walmart, and other companies as defendants accused of distributing \u201cFlowers.\u201d<\/p>\n Keep reading to find out more\u2026<\/em><\/strong><\/span><\/p>\n Tempo owns part of the U.S. copyrights to the Bruno<\/strong> song, which it acquired from co-writer Philip Lawrence<\/strong>. Bruno<\/strong>, and co-writers Ari Levine<\/strong> and Andrew Wyatt<\/strong>, are not named as plaintiffs in the suit, notably.<\/p>\n The lawsuit additionally notes that co-writer Michael Pollack<\/strong> \u201crefused to comment\u201d on the \u201cFlowers\u2019\u201d similarity to \u201cWhen I Was Your Man\u201d in an \u201cAny fan of Bruno Mars<\/strong>\u2019 \u2018When I Was Your Man\u2019 knows that Miley Cyrus<\/strong>\u2019 \u2018Flowers\u2019 did not achieve all of that success on its own. \u2018Flowers\u2019 duplicates numerous melodic, harmonic, and lyrical elements of \u2018When I Was Your Man,\u2019 including the melodic pitch design and sequence of the verse, the connecting bass-line, certain bars of the chorus, certain theatrical music elements, lyric elements, and specific chord progressions,\u201d the suit claims, saying they are \u201csubstantially similar,\u201d in particular the opening vocal line from the chorus of \u201cFlowers.\u201d<\/p>\n \u201cIt is undeniable based on the combination and number of similarities between the two recordings that \u2018Flowers\u2019 would not exist without \u2018When I Was Your Man.\u2019 With \u2018Flowers,\u2019 Cyrus<\/strong>, Hein<\/strong>, and Pollack <\/strong>have created a derivative work of \u2018When I Was Your Man\u2019 without authorization.\u201d<\/p>\n The lawsuit seeks damages \u201cin an amount to be determined at trial,\u201d or the maximum of $150,000 per infringement.<\/p>\n Find out who are the wealthiest pop stars of the \u201900s, ranked.<\/a><\/p>\n<\/div>\n
