Executives privately worried the fee was difficult to defend. Citing internal Google documents and the testimony of former Google sell-side ads executive Chris LaSala, the DOJ sought to demonstrate that Google never experienced any real pricing pressure due to its <a href=\"https:\/\/www.theverge.com\/2024\/9\/13\/24243342\/google-doj-ad-tech-antitrust-unified-pricing-rules\" target=\"_blank\" rel=\"noopener\">unshakable dominance in the market<\/a>, despite knowing its fee was higher than competitors\u2019 and being aware of <a href=\"https:\/\/www.theverge.com\/2024\/9\/11\/24241386\/former-news-corp-executive-google-doj-ad-tech-trial\" target=\"_blank\" rel=\"noopener\">customer complaints about its tools<\/a>. The trial continues this week, with YouTube CEO and former Google ads executive Neal Mohan testifying on Monday.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">According to emails presented in court, Google executives wondered whether the 20 percent fee their AdX exchange charged for facilitating transactions was sustainable and worried about how they\u2019d continue to justify it. Jonathan Bellack, another ad executive at Google, <a href=\"https:\/\/www.justice.gov\/atr\/media\/1367926\/dl\" target=\"_blank\" rel=\"noopener\">wrote in one 2018 exchange<\/a> that the fee was \u201cnot long term defensible.\u201d He also acknowledged in <a href=\"https:\/\/www.justice.gov\/atr\/media\/1367931\/dl\" target=\"_blank\" rel=\"noopener\">a different 2018 email<\/a> that the fee should get in line with market value and that it \u201cshouldn\u2019t be double the price.\u201d<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">But the pricing persisted, largely because Google could control access to a huge advertiser base through the Google Ads Network, only allowing publishers the fullest access to that market through AdX. <a href=\"https:\/\/www.justice.gov\/atr\/media\/1367941\/dl\" target=\"_blank\" rel=\"noopener\">In one 2018 email<\/a>,<strong> <\/strong>responding to another executive\u2019s question about disclosing Google\u2019s buy-side fee and how much it should be, LaSala noted that the fee for buying and selling ads \u201cholds today not because there is 20% of value in comparing 2 bids to one another, but because it comes with unique demand via AdWords that is not available any other way.\u201d He said he believed \u201ca sell-side rev share should probably top out at 10%\u201d for the open auction and that the \u201cunique demand\u201d from Google Ads was \u201cthe only reason we can sustain 20%.\u201d <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component clear-both block md:float-left md:mr-30 md:w-[320px] lg:-ml-100\">\n<div class=\"duet--article--article-pullquote mb-20\">\n<p class=\"duet--article--dangerously-set-cms-markup relative bg-repeating-lines-dark bg-[length:1px_1.2em] pb-8 font-polysans text-28 font-medium leading-120 tracking-1 selection:bg-franklin-20  dark:bg-repeating-lines-light dark:text-white dark:selection:bg-blurple\">Jonathan Bellack, another ad executive at Google, <a href=\"https:\/\/www.justice.gov\/atr\/media\/1367926\/dl\" target=\"_blank\" rel=\"noopener\">wrote in one 2018 exchange<\/a> that the fee was \u201cnot long term defensible.\u201d<\/p>\n<\/div>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">In a <a href=\"https:\/\/www.justice.gov\/atr\/media\/1367921\/dl\" target=\"_blank\" rel=\"noopener\">2019 email exchange<\/a>, LaSala recognized \u201ca continued call from buyers and publishers for transparency. It is reasonable and should not be dismissed.\u201d He also said it was \u201cquestionable\u201d the 20 percent fee was \u201creasonable long term\u201d and pointed to a signal that \u201cthe market rate\u201d for open auction ad transactions was \u201ccloser to 10%.\u201d<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Brian O\u2019Kelley, who founded AppNexus, which ran an ad exchange and unsuccessfully tried to build a publisher ad server to compete with Google\u2019s, described in a deposition AdX\u2019s 20 percent take rate as \u201cdramatically higher than competitors\u2019.\u201d<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The messages between Google executives highlight their recognition that AdX\u2019s power to link Google\u2019s publisher-side tool and its large advertiser base let the company charge an unusually high commission. While Google has argued that its system ended up benefiting all parties, the government is attempting to prove that it illegally tied together its publisher ad server and its ad exchange \u2014 not to provide better service but to maintain a monopoly. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">\u201cPublishers keep the vast majority of the revenue when they use Google\u2019s advertising technology, and our fees are transparent and in line with industry rates,\u201d Google spokesperson Jackie Bert\u00e9 said in a statement. \u201cEven when only Google\u2019s tools are used to buy and sell the ad, the publisher keeps about 70% of the revenue.\u201d\u00a0Google will get its chance to present witnesses and make its own case against the DOJ once the government\u2019s case wraps up.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Even as Google has defended its service, Google employees recognized how hard it would be for publishers to switch ad servers if they were unhappy. LaSala testified that it was a \u201cheavy lift\u201d to switch ad servers and could only think of one publisher in all his time at Google who actually did it: Disney. Rather than switch to another tool, Disney built its own. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">As Tom Kershaw, the former chief technology officer at rival ad exchange Rubicon, testified earlier in the day, \u201cI have the option to starve to death.
