In a <a href=\"https:\/\/www.documentcloud.org\/documents\/25091194-internet-archive-appeal?responsive=1&amp;title=1\" target=\"_blank\" rel=\"noopener\">decision on Wednesday<\/a>, the Second Circuit Court of Appeals ruled that permitting the Internet Archive\u2019s digital library would \u201callow for widescale copying that deprives creators of compensation and diminishes the incentive to produce new works.\u201d<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The decision is another blow to the nonprofit in the <em>Hachette v. Internet Archive<\/em> case. In 2020, four major publishers \u2014 Hachette, Penguin Random House, Wiley, and HarperCollins \u2014 <a href=\"https:\/\/www.theverge.com\/2020\/6\/1\/21277036\/internet-archive-publishers-lawsuit-open-library-ebook-lending\" target=\"_blank\" rel=\"noopener\">sued the Internet Archive<\/a> over claims its digital library constitutes \u201cwillful digital piracy on an industrial scale.\u201d<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The Internet Archive has long offered a system called the Open Library, where users can \u201ccheck out\u201d digital scans of physical books. The library was based on a principle called controlled digital lending, where each loan corresponds to a physically purchased book held in a library \u2014 avoiding, in theory, a piracy claim. It\u2019s a fundamentally different system from programs like OverDrive, where publishers sell limited-time licenses to ebooks on their own terms.<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">However, the Internet Archive <a href=\"https:\/\/blog.archive.org\/2020\/03\/30\/internet-archive-responds-why-we-released-the-national-emergency-library\/\" target=\"_blank\" rel=\"noopener\">expanded its library project during the covid-19 pandemic<\/a>. It launched the National Emergency Library, allowing an unlimited number of people to access the same copies of ebooks. That\u2019s when the publishers banded together to file the lawsuit, targeting both online libraries.<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The Second Circuit Court\u2019s decision acknowledges the benefits and drawbacks of the Internet Archive\u2019s digital library in its decision. But it ultimately sides with publishers:<\/p>\n<\/div>\n<div>\n<blockquote class=\"duet--article--blockquote jzbdts2\">\n<p class=\"duet--article--dangerously-set-cms-markup jzbdtsa jzbdts0\">On the one hand, eBook licensing fees may impose a burden on libraries and reduce access to creative work. On the other hand, authors have a right to be compensated in connection with the copying and distribution of their original creations. Congress balanced these \u201ccompeting claims upon the public interest\u201d in the Copyright Act.
