That means it\u2019s something TikTok can be held accountable for in court. Tech platforms are typically protected by a legal shield known as Section 230, which prevents them from being sued over their users\u2019 posts, and a lower court had initially dismissed the suit on those grounds. <\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">But the appeals court said the speech at issue is TikTok\u2019s own, and sent the case back to the lower court to reconsider. It will be up to that court to determine if TikTok can be held responsible in this particular case, where it faces charges including strict products liability and negligence.<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The ruling is particularly significant because it shows one area where courts may find the limits of Section 230 immunity. In July, the\u00a0<a href=\"https:\/\/www.theverge.com\/2024\/7\/1\/24166388\/supreme-court-ruling-moody-paxton-texas-florida-social-media-law\" target=\"_blank\" rel=\"noopener\">Supreme Court issued a ruling<\/a>\u00a0in a case known as<em>\u00a0Moody v. NetChoice<\/em>, over Texas and Florida\u2019s social media laws. In their decision, the justices provided a guide to how lower courts could determine\u00a0what kinds of actions by social media platforms could be considered First Amendment-protected speech. The justices included content moderation and curation in that bucket.<\/p>\n<\/div>\n<div>\n<div class=\"duet--article--article-pullquote mb-20\">\n<p class=\"duet--article--dangerously-set-cms-markup relative bg-repeating-lines-dark bg-[length:1px_1.2em] pb-8 font-polysans text-28 font-medium leading-120 tracking-1 selection:bg-franklin-20  dark:bg-repeating-lines-light dark:text-white dark:selection:bg-blurple\">The ruling is particularly significant because it shows one area where courts may find the limits of Section 230 immunity<\/p>\n<\/div>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">But SCOTUS did not weigh in on \u201calgorithms [that] respond solely to how users act online,\u201d and since the Third Circuit believes TikTok\u2019s algorithm falls into this category in this case, the judges said that its content recommendations to specific users qualifies as TikTok\u2019s \u201cown first-party speech.\u201d Section 230 only protects online platforms from being held liable for how they deal with third-party speech, like for hosting their users\u2019 posts (or choosing to remove them).<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The Third Circuit\u2019s opinion <a href=\"https:\/\/www.theverge.com\/24195235\/scotus-netchoice-kosa-kids-safety-age-verification-tiktok-ban\" target=\"_blank\" rel=\"noopener\">draws on <em>Moody<\/em><\/a> in its explanation of why TikTok should have to face a lawsuit from the mother of ten-year-old Nylah Anderson, who \u201cunintentionally hanged herself\u201d after watching videos of the so-called blackout challenge on her algorithmically-curated FYP. The \u201cchallenge,\u201d <a href=\"https:\/\/www.courtlistener.com\/docket\/63306022\/1\/anderson-v-tiktok-inc\/\" target=\"_blank\" rel=\"noopener\">according to the suit<\/a>, encouraged viewers to \u201cchoke themselves until passing out.\u201d<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">\u201cGiven the Supreme Court\u2019s observations that platforms engage in protected first-party speech under the First Amendment when they curate compilations of others\u2019 content via their expressive algorithms, it follows that doing so amounts to first-party speech under [Section] 230, too,\u201d Third Circuit Judge Patty Schwartz wrote in the opinion of the court.
