But red states and industry groups are <a href=\"https:\/\/www.reuters.com\/sustainability\/climate-energy\/25-us-states-challenge-epa-power-plant-emissions-rule-court-2024-05-09\/\" target=\"_blank\" rel=\"noopener\">challenging the EPA in court<\/a> and have <a href=\"https:\/\/www.eenews.net\/articles\/supreme-court-has-a-shot-at-stopping-another-epa-climate-rule\/\" target=\"_blank\" rel=\"noopener\">asked SCOTUS to step in<\/a> and stop the rules from being implemented while they duke it out. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The request is now in the Supreme Court\u2019s so-called \u201c<a href=\"https:\/\/www.scotusblog.com\/case-files\/emergency\/emergency-docket-2024-25\/\" target=\"_blank\" rel=\"noopener\">shadow docket<\/a>\u201d \u2014 meaning SCOTUS can essentially issue a stay on the rules at its whim. The court has already made it way tougher for federal agencies to regulate industry since Donald Trump packed it with conservative-leaning justices. This is another opportunity to gut the EPA\u2019s efforts to limit the pollution causing climate change.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component clear-both block md:float-left md:mr-30 md:w-[320px] lg:-ml-100\">\n<div class=\"duet--article--article-pullquote mb-20\">\n<p class=\"duet--article--dangerously-set-cms-markup relative bg-repeating-lines-dark bg-[length:1px_1.2em] pb-8 font-polysans text-28 font-medium leading-120 tracking-1 selection:bg-franklin-20  dark:bg-repeating-lines-light dark:text-white dark:selection:bg-blurple\">\u201cI would have considered this kind of request laughable just a few years ago.\u201d<\/p>\n<\/div>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">\u201cI would have considered this kind of request laughable just a few years ago, but given the way this court is operating \u2014 I don\u2019t laugh at anything anymore,\u201d says Sambhav Sankar, senior vice president for programs at the nonprofit environmental law organization Earthjustice.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The rules are a cornerstone of the Biden administration\u2019s efforts to meet <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/04\/22\/fact-sheet-president-biden-sets-2030-greenhouse-gas-pollution-reduction-target-aimed-at-creating-good-paying-union-jobs-and-securing-u-s-leadership-on-clean-energy-technologies\/\" target=\"_blank\" rel=\"noopener\">climate goals<\/a> set under the Paris agreement. They <a href=\"https:\/\/www.epa.gov\/system\/files\/documents\/2024-04\/cps-presentation-final-rule-4-24-2024.pdf\" target=\"_blank\" rel=\"noopener\">require coal plants<\/a> expected to continue operating for at least 15 years to reduce their climate pollution by 90 percent. Coal happens to be the dirtiest fossil fuel, creating more planet-heating carbon dioxide when burned than oil or gas. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">When the EPA finalized the plan in April, it was arguably only a partial victory for environmental and health advocates. The rules had to comply with the <a href=\"https:\/\/www.theverge.com\/2022\/6\/30\/23184791\/supreme-court-west-virginia-epa-decision-climate-change-power-plants-what-happens-next\" target=\"_blank\" rel=\"noopener\">Supreme Court\u2019s 2022 decision on <em>West Virginia v. Environmental Protection Agency<\/em><\/a><em>. <\/em>It was a monumental opinion that strengthened the \u201c<a href=\"https:\/\/crsreports.congress.gov\/product\/pdf\/IF\/IF12077\" target=\"_blank\" rel=\"noopener\">major questions<\/a>\u201d doctrine, the idea that federal agencies shouldn\u2019t have the authority to call the shots on issues of major national significance without Congress passing legislation explicitly allowing the agency to do so. The decision meant that the EPA wouldn\u2019t be allowed to determine whether the US gets its electricity from fossil fuels or cleaner sources of energy like wind and solar. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">As a result, the EPA\u2019s plans to rein in the greenhouse gas emissions allow fossil fuel power plants to keep running as long as they install technologies that capture carbon dioxide emissions. Fossil fuel companies have championed carbon capture and storage as a way to fight climate change without having to give up coal, oil, or gas. But relying on carbon capture lets down health and environmental advocates who had hoped that a transition to renewable energy would fight climate change <em>and<\/em> push utilities to phase out fossil fuel plants that spew soot and other kinds of pollutants into nearby neighborhoods. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component clear-both block md:float-left md:mr-30 md:w-[320px] lg:-ml-100\">\n<div class=\"duet--article--sidebar bg-gray-200 mb-20 w-full rounded-sm bg-[#F8F5FF] p-20 [&amp;&gt;*:last-child&gt;*:last-child]:mb-0\">\n<div class=\"[&amp;_p]:font-polysans [&amp;_p]:text-16 [&amp;_p]:font-light [&amp;_p]:leading-130\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Carbon capture and storage (CCS) is an umbrella term for a suite of<strong> <\/strong>technologies that capture carbon dioxide emissions from industrial sources including power plants, refineries, and factories. The goal is to capture carbon dioxide before it escapes into the air and then store it away to keep it from entering the atmosphere. But there are still concerns about its <a href=\"https:\/\/www.huffpost.com\/entry\/gassing-satartia-mississippi-co2-pipeline_n_60ddea9fe4b0ddef8b0ddc8f\" target=\"_blank\" rel=\"noopener\">safety<\/a>, <a href=\"https:\/\/www.theverge.com\/2023\/3\/30\/23663202\/carbon-capture-electricity-gas-coal-power-plants-climate-change\" target=\"_blank\" rel=\"noopener\">costs<\/a>, and potential to <a href=\"https:\/\/www.ciel.org\/issue\/carbon-capture-and-storage\/\" target=\"_blank\" rel=\"noopener\">prolong the use of fossil fuels<\/a>.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Now, industry is arguing that carbon capture and storage (CCS) technologies aren\u2019t even ready to help fight climate change \u2014 at least not to the degree the EPA says is feasible in its power plant rules. Since July, trade groups <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/national-rural-electric-cooperative-v-environmental-protection-agency\/\" target=\"_blank\" rel=\"noopener\">representing<\/a> <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/edison-electric-institute-v-environmental-protection-agency\/\" target=\"_blank\" rel=\"noopener\">utilities<\/a> and <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/national-mining-association-and-americas-power-v-environmental-protection-agency\/\" target=\"_blank\" rel=\"noopener\">mining<\/a> <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/nacco-natural-resources-corporation-v-environmental-protection-agency\/\" target=\"_blank\" rel=\"noopener\">companies<\/a> and a smattering of red states, led by <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/west-virginia-v-environmental-protection-agency-2\/\" target=\"_blank\" rel=\"noopener\">West Virginia<\/a> and <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/ohio-v-environmental-protection-agency-2\/\" target=\"_blank\" rel=\"noopener\">Ohio<\/a>, have filed applications asking the Supreme Court to issue a stay on the EPA\u2019s new rules for CO2 emissions (<a href=\"https:\/\/thehill.com\/policy\/energy-environment\/4835399-states-coal-companies-supreme-court-biden-rule-pollution\/?utm_source=pocket_saves\" target=\"_blank\" rel=\"noopener\">as well as<\/a> <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/nacco-natural-resources-corporation-v-environmental-protection-agency-2\/\" target=\"_blank\" rel=\"noopener\">separate rules for hazardous pollutants<\/a>, <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/north-dakota-v-environmental-protection-agency-3\/\" target=\"_blank\" rel=\"noopener\">including<\/a> <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/midwest-ozone-group-v-environmental-protection-agency-2\/\" target=\"_blank\" rel=\"noopener\">mercury<\/a>).<strong> <\/strong>The US Court of Appeals for the District of Columbia Circuit <a href=\"https:\/\/apnews.com\/article\/epa-power-plants-coal-appeals-court-biden-3383164580dfb0f0cee57e1f0edbd025\" target=\"_blank\" rel=\"noopener\">previously declined<\/a> <a href=\"https:\/\/www.eenews.net\/articles\/dc-circuit-wont-halt-epa-mercury-rule\/\" target=\"_blank\" rel=\"noopener\">to issue a stay<\/a>.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The petitioners argue that capturing 90 percent of CO2 isn\u2019t an achievable goal yet \u2014 that the technology hasn\u2019t been demonstrated at that scale and that there aren\u2019t pipelines in place to transport and store the greenhouse gas safely once it\u2019s been captured. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">\u201cWith no way to comply with the 90% CCS system, the Rule requires operators to shift electricity generation,\u201d the\u00a0National Rural Electric Cooperative Association says in its <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24A96\/319665\/20240723164528356_Application%20for%20Stay.pdf\" target=\"_blank\" rel=\"noopener\">application<\/a> for a stay. \u201cEPA is once again trying to transform the power sector by forcing a shift in electricity generation to its favored sources.\u201d They\u2019re basically invoking the major questions doctrine again to challenge the new rules. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">The Biden administration defended the EPA\u2019s rules in a <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24A96\/322790\/20240819142208614_24A95%20EPA%20Response.pdf\" target=\"_blank\" rel=\"noopener\">response<\/a> filed to the Supreme Court this week, saying that the agency has vetted the technology and set achievable carbon capture goals. The case \u201cdoes not involve the type of fundamental statutory-interpretation issue that might warrant this Court\u2019s intervention,\u201d the EPA argues. And it points out that a federal appeals court chose not to issue a stay on the matter last month, in a <a href=\"https:\/\/www.edf.org\/sites\/default\/files\/2024-07\/Stay%20Motions%20DENIED%20July%2019%202024.pdf\" target=\"_blank\" rel=\"noopener\">decision<\/a> that says the litigants haven\u2019t shown that they\u2019ll be able to successfully challenge the merits of the rule, nor that the case involves a \u201cmajor question.\u201d Moreover, deadlines to comply with the rules don\u2019t kick in until 2030 or 2032 \u2014 making it hard for the petitioners to show that they\u2019d suffer \u201cirreparable harm\u201d without a stay.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Nevertheless, the groups have since asked the Supreme Court to issue a stay through its emergency \u2014 or shadow \u2014 docket. The emergency docket, once reserved for extremely time-sensitive issues like staying executions, is now crowded with requests to pause environmental regulations. It\u2019s an expedited process, allowing the court to issue decisions without much briefing on the issue or hearing oral arguments on the case.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component clear-both block md:float-left md:mr-30 md:w-[320px] lg:-ml-100\">\n<div class=\"duet--article--article-pullquote mb-20\">\n<p class=\"duet--article--dangerously-set-cms-markup relative bg-repeating-lines-dark bg-[length:1px_1.2em] pb-8 font-polysans text-28 font-medium leading-120 tracking-1 selection:bg-franklin-20  dark:bg-repeating-lines-light dark:text-white dark:selection:bg-blurple\">\u201cMany lawyers and others find it deeply disturbing.\u201d<\/p>\n<\/div>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">\u201cMany lawyers and others find it deeply disturbing,\u201d says Michael Gerrard, founder and faculty director of Columbia University\u2019s\u00a0Sabin Center for Climate Change Law. \u201cThe Supreme Court can do something colossally important without the full information in front of it.\u201d<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">It\u2019s a trend that\u2019s grown since 2016 when the Supreme Court issued a surprise stay on the Obama administration\u2019s attempt at regulating greenhouse gas emissions from power plants. The Obama-era rules never went into effect and were eventually <a href=\"https:\/\/www.vox.com\/2019\/6\/19\/18684054\/climate-change-clean-power-plan-repeal-affordable-emissions\" target=\"_blank\" rel=\"noopener\">rolled back by the Trump administration<\/a>.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Now, history could repeat itself. Donald Trump has <a href=\"https:\/\/www.foxbusiness.com\/politics\/trump-vows-repeal-new-epa-power-plant-rule\" target=\"_blank\" rel=\"noopener\">pledged to throw out power plant emissions rules<\/a> once again on the presidential campaign trail. And the Supreme Court can decide at any moment whether to grant the stay. Their decision could potentially influence the case<strong> <\/strong>the US Court\u00a0of\u00a0Appeals\u00a0for the\u00a0DC Circuit is still considering over whether the rules <a href=\"https:\/\/www.electric.coop\/electric-co-ops-file-suit-over-epa-power-plant-rule\" target=\"_blank\" rel=\"noopener\">should be<\/a> <a href=\"https:\/\/www.capito.senate.gov\/news\/in-the-news\/west-virginia-joins-suit-aimed-at-overturning-epa-power-plant-rules\" target=\"_blank\" rel=\"noopener\">struck down<\/a> altogether. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">SCOTUS\u2019s decision on the stay could potentially also influence new rules the EPA is <a href=\"https:\/\/www.theverge.com\/2024\/4\/25\/24139494\/power-plant-pollution-epa-final-rule-climate\" target=\"_blank\" rel=\"noopener\">still crafting for existing gas-fired power plants<\/a> that make up a bigger source of electricity than coal in the US. Those rules <a href=\"https:\/\/www.washingtonpost.com\/climate-environment\/2024\/02\/29\/epa-gas-power-plant-rule\/\" target=\"_blank\" rel=\"noopener\">aren\u2019t expected until after the November elections<\/a>, giving Trump another chance to reverse course. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">\u201cI think what will be more relevant will be the outcome of the coming election,\u201d Sankar says. Then again, the Supreme Court has shocked the legal community with landmark decisions lately that hamstring the EPA\u2019s ability to craft regulation.
