Google<\/em><\/a>, Donato held his final hearing on remedies today. While we don\u2019t yet know what will happen, he repeatedly shut down any suggestion that Google shouldn\u2019t have to open up its store to rival stores, that it\u2019d be too much work or cost too much, or that the proposed remedies go too far. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">\u201cWe\u2019re going to tear the barriers down, it\u2019s just the way it\u2019s going to happen,\u201d said Donato. \u201cThe world that exists today is the product of monopolistic conduct. That world is changing.\u201d Donato will issue his final ruling in a little over two weeks.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white won the jury trial last December, it\u2019s been up to the judge to decide how to fix the damage that Google\u2019s monopoly caused. <a href=\"https:\/\/www.theverge.com\/2024\/4\/12\/24128531\/epic-google-proposed-injunction-remedies\" target=\"_blank\" rel=\"noopener\">In April, Epic revealed<\/a> it was asking the court to effectively crack the Google Play store wide open \u2014 by forcing Google to let rival stores live inside its own Google Play store and giving them access to every Google Play app, too.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">That way, an Android user could freely decide whether they prefer Google or someone else as their app landlord.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 dark:[&amp;_a]:shadow-underline-white\">Surprisingly, today\u2019s final hearing on remedies began with both parties <em>agreeing <\/em>that opening up the Play Store is doable, perhaps not even that hard \u2014 but they fought about how long it would take, how much it would cost, and especially whether Google would be able to force every app in every rival store to undergo human review by Google before it lets those stores into Google Play. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Google argued that it shouldn\u2019t hypothetically be forced to carry a Nazi app, as one example: \u201cIf the American Nazi Party app came to Play, Play would say no,\u201d said Google\u2019s lead attorney, Glenn Pomerantz.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component clear-both block md:float-left md:mr-30 md:w-[320px] lg:-ml-100\">\n<div class=\"duet--article--article-pullquote mb-20\">\n<p class=\"duet--article--dangerously-set-cms-markup relative bg-repeating-lines-dark bg-[length:1px_1.2em] pb-8 font-polysans text-28 font-medium leading-120 tracking-1 selection:bg-franklin-20  dark:bg-repeating-lines-light dark:text-white dark:selection:bg-blurple\">\u201cWhen you have a mountain that\u2019s built out of bad conduct, you have to move that mountain.\u201d \u2014 Judge Donato<\/p>\n<\/div>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">But Epic lead attorney Gary Bornstein later countered: \u201cIf Google is actually reviewing every single app on a third-party store, it gives Google the gatekeeping authority it has already abused.\u201d And Judge Donato made it clear he plans to ban any nondiscriminatory behavior when it comes to how Google treats rival app stores, up to and including human review.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">In his closing argument, Pomerantz came close to suggesting that the direction Judge Donato is aiming constitutes Soviet Russia-era communism, arguing that courts have previously said \u201ccentral planning,\u201d of the sort that would force Google to carry rival app stores in order to create new competition, isn\u2019t allowed. (Earlier, Donato said, \u201cThe whole point of this is to grow a garden of competitor app stores.\u201d)<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">But Donato said he won\u2019t \u201cmicromanage\u201d Google here or centrally plan the results.
