{"id":108755,"date":"2024-07-01T15:49:38","date_gmt":"2024-07-01T15:49:38","guid":{"rendered":"https:\/\/entertainment.runfyers.com\/index.php\/2024\/07\/01\/supreme-court-immunity-decision-could-put-donald-trump-above-the-law\/"},"modified":"2024-07-01T15:49:38","modified_gmt":"2024-07-01T15:49:38","slug":"supreme-court-immunity-decision-could-put-donald-trump-above-the-law","status":"publish","type":"post","link":"https:\/\/entertainment.runfyers.com\/index.php\/2024\/07\/01\/supreme-court-immunity-decision-could-put-donald-trump-above-the-law\/","title":{"rendered":"Supreme Court Immunity Decision Could Put Donald Trump \u201cAbove the Law\u201d"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p class=\"has-dropcap\">The Supreme Court dealt a significant blow to <strong>Jack Smith<\/strong>&#8216;s election subversion case against <strong>Donald Trump<\/strong>, with the six conservatives agreeing Monday with the former president that he should enjoy \u201cabsolute immunity from criminal prosecution for actions\u201d undertaken as part of his official duties. \u201cSuch an immunity is required to safeguard the independence and effective functioning of the Executive Branch,\u201d Chief Justice <strong>John Roberts<\/strong> wrote in the <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-939_e2pg.pdf\" target=\"_blank\" rel=\"noopener\">majority opinion<\/a>, \u201cand to enable the President to carry out his constitutional duties without undue caution.\u201d<\/p>\n<p>Though Roberts wrote that Trump \u201casserts a far broader immunity than the limited one we have recognized,\u201d he and his conservative supermajority in their stunning 6-3 decision greatly expanded the scope of executive power\u2014putting presidents, in some ways, above the law, as liberal justice <strong>Sonia Sotomayor<\/strong> wrote in a scathing dissent. \u201cToday&#8217;s decision to grant former Presidents criminal immunity reshapes the institution of the presidency,\u201d Sotomayor wrote. \u201cIt makes a mockery of the principle, foundational to our Constitution and system of Government, that no man is above the law.\u201d<\/p>\n<p class=\"paywall\">\u201cWith fear for our democracy,\u201d Sotomayor added, \u201cI dissent.\u201d<\/p>\n<p class=\"paywall\">The high court had done Trump a favor just in hearing the ludicrous case, in which his legal team had <a href=\"https:\/\/www.rollingstone.com\/politics\/politics-news\/supreme-court-trump-immunity-oral-arguments-1235010538\/\" target=\"_blank\" rel=\"noopener\">suggested<\/a> a president could legally assassinate his political opponents. But the court\u2019s slow-moving approach to the case has all but assured that a trial won\u2019t take place before the November election, and the court&#8217;s conservatives could derail it entirely now with their decision holding that a president \u201cis entitled, at a minimum, to a presumptive immunity from prosecution for all his official acts\u201d and sending the matter back to the lower courts.<\/p>\n<p class=\"paywall\">\u201cBIG WIN FOR OUR CONSTITUTION AND DEMOCRACY,\u201d Trump <a data-offer-url=\"https:\/\/x.com\/TrumpDailyPosts\/status\/1807787920058937774\" class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/x.com\/TrumpDailyPosts\/status\/1807787920058937774&quot;}\" href=\"https:\/\/x.com\/TrumpDailyPosts\/status\/1807787920058937774\" rel=\"nofollow noopener\" target=\"_blank\">cheered<\/a> on his social media page. \u201cPROUD TO BE AN AMERICAN.\u201d<\/p>\n<p class=\"paywall\">The former president\u2014who was charged by Smith with four federal felonies over his efforts to overturn his 2020 election loss to <strong>Joe Biden<\/strong>\u2014has insisted that he has \u201ctotal immunity\u201d from prosecution, and his legal team argued to the high court that presidents \u201cwill not be able to properly function, or make decisions\u201d without it.<\/p>\n<p class=\"paywall\">It\u2019s an absurd position, one that would essentially hold that the law does not apply to the most powerful person in the country. But the court <a href=\"https:\/\/www.vanityfair.com\/news\/supreme-court-to-hear-donald-trump-immunity-claim\" target=\"_blank\" rel=\"noopener\">agreed<\/a> to take up the case in February, and members of its 6-3 conservative majority seemed to <a href=\"https:\/\/www.vanityfair.com\/news\/supreme-court-justice-samuel-alito-argues-presidents-must-be-allowed-to-commit-federal-crimes-or-democracy-as-we-know-it-will-be-over\" target=\"_blank\" rel=\"noopener\">give credence<\/a> to the Trump team\u2019s outrageous claims in oral arguments back in April.<\/p>\n<p class=\"paywall\">As right-wing justice <strong>Samuel Alito<\/strong> asked at the time, \u201cIf an incumbent who loses a very close, hotly contested election knows that a real possibility after leaving office is not that the president is going to be able to go off into a peaceful retirement, but that the president may be criminally prosecuted by a bitter political opponent, will that not lead us into a cycle that destabilizes the functioning of our country as a democracy?\u201d<\/p>\n<p class=\"paywall\">But what Alito and company did in Monday\u2019s ruling, legal experts warn, <em>could<\/em> destabilize democracy.<\/p>\n<p class=\"paywall\">\u201cOur democracy has been gravely wounded,\u201d <a data-offer-url=\"https:\/\/x.com\/EricHolder\/status\/1807794248894292203\" class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/x.com\/EricHolder\/status\/1807794248894292203&quot;}\" href=\"https:\/\/x.com\/EricHolder\/status\/1807794248894292203\" rel=\"nofollow noopener\" target=\"_blank\">wrote<\/a> former Attorney General <strong>Eric Holder<\/strong> on X. \u201cThe Trump immunity decision says: a president CAN VIOLATE THE CRIMINAL LAW if he acts within his broadly defined \u2018constitutional authority.\u2019 Absurd and dangerous. Meanwhile, the latter\u2019s wife, <strong>Ginni Thomas<\/strong>, attended both the rally that proceeded that day\u2019s attack on the Capitol and pressed Trump allies to overturn his loss.
