CAIDP president Marc Rotenberg was one of the letter\u2019s signatories, alongside a number of AI researchers and OpenAI co-founder Elon Musk. Similar to that letter, the complaint calls to slow down the development of generative AI models and implement stricter government oversight.<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple\"><a href=\"https:\/\/www.caidp.org\/app\/download\/8450269463\/CAIDP-FTC-Complaint-OpenAI-GPT-033023.pdf?t=1680174598\" target=\"_blank\" rel=\"noopener\">The CAIDP complaint<\/a> points out potential threats from OpenAI\u2019s GPT-4 generative text model, which was <a href=\"https:\/\/www.theverge.com\/2023\/3\/14\/23638033\/openai-gpt-4-chatgpt-multimodal-deep-learning\" target=\"_blank\" rel=\"noopener\">announced in mid-March<\/a>. They include ways that GPT-4 could produce malicious code and highly tailored propaganda as well as ways that biased training data could result in baked-in stereotypes or unfair race and gender preferences in things like hiring. It also points out significant privacy failures with OpenAI\u2019s product interface \u2014 like <a href=\"https:\/\/www.theverge.com\/2023\/3\/24\/23655622\/chatgpt-outage-payment-info-exposed-monday\" target=\"_blank\" rel=\"noopener\">a recent bug that exposed<\/a> OpenAI ChatGPT histories and possibly payment details to other users.<\/p>\n<\/div>\n<div>\n<div class=\"duet--article--article-pullquote mb-20\">\n<p class=\"duet--article--dangerously-set-cms-markup relative bg-repeating-lines-dark bg-[length:1px_1.2em] pb-8 font-polysans text-28 font-medium leading-120 tracking-1 selection:bg-franklin-20  dark:bg-repeating-lines-light dark:text-white dark:selection:bg-blurple\">\u201cOpenAI released GPT-4 to the public for commercial use with full knowledge of these risks.\u201d<\/p>\n<\/div>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple\">OpenAI has openly noted potential threats from AI text generation, but CAIDP argues that GPT-4 crosses a line of consumer harm that should draw regulatory action. It seeks to hold OpenAI liable for violating Section 5 of the FTC Act, which prohibits unfair and deceptive trade practices. \u201cOpenAI released GPT-4 to the public for commercial use with full knowledge of these risks,\u201d including potential bias and harmful behavior, the complaint claims. It also defines <a href=\"https:\/\/en.wikipedia.org\/wiki\/Hallucination_(artificial_intelligence)\" target=\"_blank\" rel=\"noopener\">AI hallucinations<\/a>, or\u00a0the phenomenon of generative models confidently making up nonexistent facts,\u00a0as a form of deception. \u201cChatGPT will promote deceptive commercial statements and advertising,\u201d it warns \u2014 potentially bringing it under the FTC\u2019s purview.<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple\">In the complaint, CAIDP asks the FTC to halt any further commercial deployment of GPT models and require independent assessments of the models before any future rollouts. It also asks for a publicly accessible reporting tool similar to the one that allows consumers to file fraud complaints. It\u2019s warned in recent years that biased AI systems <a href=\"https:\/\/www.theverge.com\/2021\/4\/20\/22393873\/ftc-ai-machine-learning-race-gender-bias-legal-violation\" target=\"_blank\" rel=\"noopener\">could draw enforcement action<\/a>, and in a <a href=\"https:\/\/www.theverge.com\/2023\/3\/28\/23660101\/ai-competition-ftc-doj-lina-khan-jonathan-kanter-antitrust-summit\" target=\"_blank\" rel=\"noopener\">joint event this week<\/a> with the Department of Justice, FTC Chair Lina Khan said the agency would be looking for signs of large incumbent tech companies trying to lock out competition.
