The \u2018Rags to Riches\u2019 singer passed away aged 96 at his home in New York on 21 July, 2023, after a seven-year battle with Alzheimer\u2019s disease, and his children Antonia Bennett and Johanna Bennett have now filed a lawsuit against their brother D\u2019Andrea \u2018Danny\u2019 Bennett for an undisclosed amount over their late father\u2019s trust and assets.<\/p>\n
Antonia and Johanna named their other brother Daegal \u2018Dae\u2019 Bennett, and Tony\u2019s widow Susan Benedetto as additional respondents in the filing.<\/p>\n
Antonia and Johanna say in their court papers they are seeking \u201cequitable relief\u201d as they believe proceeds from the sale of some of Tony\u2019s assets to brand development firm Iconoclast were not accounted for by Danny \u2013 who was Tony\u2019s manager and is the trustee of the Family Trust.<\/p>\n
The sisters claim that in his role as Tony\u2019s manager, Danny obtained \u201cpersonal benefits\u201d for \u201chimself and his company\u201d as the result of transactions made on behalf of Tony, Benedetto Arts, LLC, and the family trust.<\/p>\n
\nThey include the sale and consignment of his late father’s memorabilia and personal property.<\/p>\n
\nAntonia and Johanna also allege their brother and his legal team have \u201cpersistently\u201d failed and refused to provide full context when it comes to Tony\u2019s property and assets in which they have rights and interests as beneficiaries.<\/p>\n
\nTony is said to have died with a net worth of $200 million.<\/p>\n
\nAntonia and Johanna say in their filing: \u201cAlthough Danny and his counsel have provided piecemeal information and produced some documents to Petitioners\u2019 counsel, the information provided raises more questions than answers and fails to provide anything close to an accounting of Tony\u2019s assets and financial affairs.\u201d<\/p>\n
\nThe sisters add they have \u201cwell-founded concerns\u201d about father-of-four Tony\u2019s finances and assets involving FamilyTrust assets and Benedetto Arts, LLC prior to and following his death.<\/p>\n
\nThey are requesting all property and assets are \u201cinventoried\u201d, accounted for, and distributed \u201cpursuant to the express terms of the Family Trust\u201d.<\/p>\n
\nDanny will need to turn over all principal, interest, receipts, disbursements, expenditures and tax returns.<\/p>\n<\/div>\n
