A man in Maine allegedly broke into an apartment, unwrapped Christmas gifts and took a nap before he was caught and refused to leave the residence.

Police said the apartment’s tenant woke up to find Jose Harvey sleeping on the couch on Sunday, November 23, according to Maine outlets WGME and WABI. The resident called police around 8:40 a.m. and claimed that Harvey, 50, allegedly refused to leave.

Officers arrived at the scene in Bangor, Maine, and confronted Harvey, who could not provide a logical reason for why he was in the residence, according to WGME and WABI.

Additionally, police said that they discovered unwrapped Christmas presents close to where Harvey was found in the apartment.

The outlets reported that Harvey was arrested and charged with aggravated criminal trespass, while he was taken to Penobscot County Jail. However, he is no longer being held at the jail, according to jail records viewed by People. Additionally, it does not appear that Harvey has retained a lawyer as of time of publication.

Following the incident, the tenant told authorities that the bathroom window was open and the doors were unlocked before Harvey entered the property.

It is not currently clear why Harvey allegedly broke into the apartment or if he had any connection to the tenant.

After WABI shared coverage about the alleged break-in, the Bangor Police Department reshared the outlet’s story on Facebook and urged people to stay safe during the holiday season.

“It goes without saying that doing a routine check of your window and door locks is a prudent exercise in this day and age. I know, we shouldn’t have to—it makes us sad, too,” the department wrote in a November 25 post. “Surprises like this don’t put any of us in a festive mood, but even the Grinch figured out the chimney is always an option.”

The department continued, “It pays to lock your doors and windows. Oh, and make sure that gifts and packages are not left in the automobiles, even if it’s in your own dooryard. Keep them out of sight on shopping excursions as well.”

“Keep your hands to yourself, leave other people’s things alone, and be kind to one another,” the department concluded in the post.
