Judge Arun Subramanian is denying Diddy‘s team’s motion for a mistrial.
The legal team of the 55-year-old music mogul requested for a mistrial, based on the testimony of ex Cassie‘s friend Bryana Bongolan, who claimed that he dangled her over a 17th-story apartment balcony in Los Angeles in 2016.
The defense claimed that the friend and Cassie lied about the balcony incident, alleging that the testimony was perjured, per NBC News.
The defense said that Diddy was on the East Coast at the time of the alleged incident, staying at the Trump Hotel in New York.
The judge ruled that this was not enough to be considered a mistrial, and that the defense did not object to her testimony, and they were allowed to conduct a cross-examination.
Judge Arun Subramanian added that “the government screwed up,” but that wasn’t grounds for a mistrial. He noted Diddy‘s defense attorney, Nicole Westmoreland, “had a real Perry Mason moment,” referring to a dramatic revelation in a courtroom.
Cassie mentioned the balcony incident in her 2023 lawsuit, as well as during her testimony, but she did not name her friend at the time.
