P!nk has reportedly filed legal paperwork against Pharrell Williams, claiming that he should not be allowed to trademark his P.Inc business, this according to Rolling Stone.
P!nk filed her trademark in 2001, but feels that Pharrell’s is too similar to the sound and spelling of hers. Her lawyers now are aiming to have the Trademark Trial And Appeal Board continue to oppose Pharrell’s registration, along with giving her “any and all further relief.”
“[Williams’] P.INC Mark is similar to the PINK Marks in sight, sound, meaning and commercial impression,” the filing reportedly reads. “[Williams] and [Pink’s] goods and services are identical and/or closely related… [Williams] is likely to market and promote its goods through the same channels of trade and to the same consumers as [Pink].”
Victoria’s Secret filed its own case against Pharrell’s company last month, making similar arguments that Pharrell’s trademark would be confusingly similar to its own name.
“Opposer’s use of its ‘Victoria’s Secret PINK’ and ‘PINK’ marks predates applicant’s filing date,” the company’s lawyers wrote in a March 21 filing. “Applicant’s mark is highly similar to, and is the phonetic equivalent of, opposer’s ‘PINK’ marks.”
